KPU Reported To Bawaslu Regarding The Constitutional Court's Decision On The Terms For Presidential And Vice Presidential Candidates

JAKARTA - Civilian society on behalf of Ammunition Care for Democracy reported the General Election Commission (KPU) to the Election Supervisory Agency (Bawaslu) related to the Constitutional Court Decision (MK) Number 90/PUU-XXI/2023 (MK Decision Number 90) which amended the nomination requirements for the president and vice president.

Ammunition Cares for Democracy assessed that the KPU supports the Constitutional Court's decision which does not reflect the value of democracy through the issuance of KPU Regulation Number 23 of 2023.

"We ask Bawaslu to be responsive and follow up on all forms of fraud in holding elections, including in the stages of forming regulations by the RK KPU, especially in the formation of PKPU 23/2023 which contains serious legal defects," said Chairman of the Ammunition Care Advocacy Team for Democracy Kurnia Saleh, quoted by ANTARA, Monday, November 13.

PKPU Number 23 of 2023 is considered a portrait of the KPU's position, and these rules are considered formal and substantial defects.

Kurnia Saleh also asked the KPU to postpone the determination of the presidential and vice presidential candidate pairs until the judicial review of KPU Regulation Number 23 of 2023 is decided.

Previously, Ammunition Cares for Democracy had submitted a judicial review of the PKPU to the Supreme Court (MA) which was asked to be independent and free from all forms of intervention.

The Constitutional Court's decision, which is the basis for PKPU Number 23 of 2023, is considered to legalize dynasties in Indonesia, which is a democratic country.

His party understands the judicial review as an instrument for everyone to correct public policies at the level of laws and regulations.

"However, we need to convey that policy corrections are running when our democracy is also in good condition, not in a situation that has made us all chaotic lately," he said.
