Proven Corruption, Former Chairman Of Bawaslu Sentenced To 4 Years In Prison

The panel of judges at the Medan District Court (PN), North Sumatra (North Sumatra) sentenced the defendant Eva Juliani Br Pandia, the former chairman of the Karo Regency Bawaslu for four years in prison.

In addition, the defendant Dian Ika Yoes Refida, a former treasurer of the Karo Bawaslu expenditure, was sentenced to four years in prison in a grant case for the 2019 fiscal year for the 2020 Karo regent election.

"The two defendants were subject to a fine of Rp. 100 million on the condition that if the fine could not be paid, it was replaced with imprisonment for three months," said Chief Judge Immanuel Tarigan at the Medan District Court (PN) as reported by ANTARA, Monday, November 6.

The panel of judges believes that the two defendants fulfilled the elements of committing criminal acts Article 2 paragraph 1 in conjunction with Article 18 of Law No. 31 has been amended by Law No. 20 of 2021 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.

Namely, said Immanuel, the essence of the article is without the right to enrich oneself or other people or corporations which resulted in state financial losses of IDR 217 million.

Therefore, the panel of judges also gave Dian Ika Yoes Refida an additional penalty of Rp217 million at a maximum of one month for permanent legal force, if he did not pay, the prosecutor would charge the property, if it was not sufficient to be sentenced to 1.5 years.

Meanwhile, Eva Juliani Br Pandia is subject to a replacement money of Rp68 million for a maximum of one month against permanent legal force, if he does not pay, then the property will be auctioned off by the prosecutor, if it is not sufficient, he will be sentenced to 1.5 years.

"The aggravating thing for the two defendants did not support the government's program to eradicate corruption, while mitigating factors were never punished and regretted their actions," said Immanuel.

After reading the verdict, the panel of judges gave the Public Prosecutor (JPU) Karo, the defendant and the defendant's legal adviser.

This decision is lighter than the demands of the Public Prosecutor's Office, Karo Alfonso Manurun, who demanded that Eva Juliani Br Pandia, the former Head of Bawaslu, Karo Regency, be in prison for 7.5 years, a fine of Rp. 250 million, subsidiary to three months in prison and UP to Rp. 821 million, subsidiary to 3.5 years.

Meanwhile, Dian Ika Yoes Refida, a former expenditure treasurer, was charged with 5.5 years of a three-month subsidiary and UP fine of IDR 217 million, a subsidiary of 2.5 years in prison.
