Hasyim Asy'ari: PKPU Regarding Registration Of Presidential And Vice Presidential Candidates Is Legal

Chairman of the Indonesian General Elections Commission (KPU) Hasyim Asy'ari said that he had signed a KPU regulation regarding the registration of presidential and vice presidential candidates on Monday, October 9 so that the regulation was valid for implementation. "I have signed the KPU regulation since last Monday, October 9, 2023," said Hasyim in Jakarta, as reported by Antara, Thursday, October 12. He referred to Law Number 12 of 2011 concerning the Establishment of Regulations, which states that a regulation can be considered legal if the leader of the related institution has been signed. "A statutory regulation is valid since it was signed by the legislator," he explained. This makes the regulation legal since it was signed without the need to wait for it to be promulgated. The KPU has also submitted the PKPU to the Ministry of Law and Human Rights to be promulgated. "The current process is that the KPU, in my sense as the chairman of the KPU, has signed the regulation. We are waiting for the invitation at the Ministry of Law and Human Rights," said Hasyim. The Indonesian KPU will open registration for prospective presidential and vice presidential candidates from 19 to 25 October 2023 at 08.00-16.00 WIB and on the last day it will be opened until 23.59 WIB. Meanwhile, the registration of prospective legislative candidates (caleg) is opened shorter than the registration of prospective presidential and vice presidential candidates or only six days. Hasyim added that the registration time for the legislative candidate is no different from the registration of the prospective presidential and vice presidential candidate, which is 08.00-16.00 WIB.

The registration place for the prospective presidential and vice-presidential candidates for the DPR RI is at the KPU RI Office, Jakarta.
