The Ministry Of Environment And Forestry Has Determined That The Boss Of The Copper Merger Company Is A Suspect In Environmental Pollution

JAKARTA - The Ministry of Environment and Forestry (KLHK) has determined the status of a suspect to the President Director of PT XLI with the initials BSS, who is 47 years old, for cases of environmental pollution and illegally importing B3 waste.

Director General of Law Enforcement and Environment of the Ministry of Environment and Forestry, Rasio Ridho Sani, said investigators named BSS as an individual suspect and PT XLI as a corporate suspect.

"The company is disbursing copper waste that has an impact on the environment," he said as quoted by ANTARA, Monday, August 14.

Rasio explained that PT XLI is a foreign investment company located in the Cikande Modern Industrial Estate, Jalan Modern Industri VI Blok P.1 B, Cijeruk Village, Kibin District, Serang Regency, Banten.

The Ministry of Environment and Forestry ensnared BSS with multiple articles by referring to Law Number 32 of 2009 concerning environmental protection and management, namely Article 98, Article 103, Article 106, Article 116, and Article 119.

According to Rasio, the imposition of multiple articles was due to deliberately committing acts that ignored the neglect of ambient air quality standards, water quality standards, sea water quality standards, or standard criteria for environmental damage.

Then produce B3 waste and do not manage and enter B3 waste into Indonesian territory.

"The maximum penalty is 15 years in prison and a fine of Rp. 15 billion and additional criminal confiscation of profits and environmental restoration," said Rasio.

The investigation case files for the BSS individual suspect and the PT XLI corporate suspect have been submitted to the Serang District Attorney.

Currently, the suspect BSS is being held at the Salemba Class I Rutan, Jakarta. The government has also closed the metal smelter company.

Director of Criminal Law Enforcement of the Ministry of Environment and Forestry Yazid Nurhuda said the handling of the case was a follow-up to public submissions that were restless due to the melting of copper contaminating the air.

The case is also a development of a complaint about the illegal burning of B3 waste in Tegal Angus Village, Teluk Naga District, Tangerang Regency, Banten, which sells the results of the burning of the B107d waste code Printed Circuit Board (PCB) electronic waste to PT XLI.

Furthermore, the KLHK supervisory team verified the complaint which was followed by the activity of collecting materials and information together with investigators.

Based on the results of the collection of materials and information, copper waste was found. Meanwhile, the company's raw materials are suspected of being waste, including copper ash,copper zinc sulfide, and other waste. The waste is imported from Madagascar, Korea, Singapore, Germany, Malaysia, America, and other countries.

Yazid explained that after fulfilling two sufficient pieces of evidence based on the statements of witnesses, expert statements, and the results of laboratory analysis tests, KLHK investigators increased the handling of the case to the investigation stage by naming BSS and PT XLI as suspects.
