Non-judicial Settlement, Not Eliminating Judicial Serious Human Rights Violations

Coordinating Minister for Political, Legal and Security Affairs (Menkopolhukam) Mahfud MD said that the non-judicial resolution of gross human rights violations (HAM) was a humanitarian call.

Mahfud MD emphasized that the non-judicial settlement of gross human rights violations did not cover the settlement of gross human rights violations judicially.

"So that there is no misunderstanding as if this non-judicial settlement has closed a case that is juridical in nature, no. This is our humanitarian call as a nation to the victims, not to the perpetrators," Mahfud was quoted as saying by ANTARA, Tuesday, July 4.

The Coordinating Minister for Political, Legal and Security Affairs explained that the settlement of gross human rights violations judicially often encounters a number of challenges due to the aspect of evidence. For example, 35 defendants from four cases of resolving gross human rights violations were judicially released.

"How do you want to prove, especially if it is considered that the perpetrators have all died. In the law, if it is suspected that the perpetrator has died, the case will be closed," he said.

He emphasized that the settlement of gross human rights violations focused on restoring the victim's rights.

"In fact, there were already many victims, the house caught fire, was also shot from the incident, parents were also killed, even though they didn't participate, that's the victim. That's what we are now compensationing," he said.

For this reason, he emphasized that the non-judicial resolution of gross human rights violations focuses on restoring the rights of victims, not ignoring the judicial process.

"We will complete non-judicial, the judicial settlement will only run," he added.

At the beginning, Mahfud explained that his presence at the working meeting of Committee I DPD RI was intended to provide a more comprehensive explanation of the non-judicial resolution of gross human rights violations in the past.

Previously, Tuesday, June 27, Indonesian President Joko Widodo officially launched a program to implement recommendations for the non-judicial settlement of gross human rights violations (HAM) in Indonesia starting from Aceh, Tuesday, in an effort to restore the rights of victims.

"By saying bismillahirrahmanirrahim, this afternoon, I officially launch a program to implement the recommendation for the non-judicial settlement of gross human rights violations in Indonesia," Jokowi said in Pidie Regency, Aceh, Tuesday.
