Public Policy Observer: PJ Governor Heru Budi Doesn't Seems To Have The Guts To Dismantle Ancol Case

JAKARTA - The stalled development project in Ancol to the case of termination of investigation or SP3 against Fredie Tan related to the alleged looting of a number of BUMD assets belonging to the DKI Provincial Government which were suspected of causing losses to the state finances of tens of billions of rupiah had trending hashtag #usutkorupsiancol.

However, Acting Governor of DKI Jakarta Heru Budi Hartono was reluctant to comment on the problems that were happening within Ancol's company, ranging from stalled projects to internal conflicts.

Responding to this, Trisakti University Public Policy Observer, Dr. Drs. Trubus Rahardiansah assessed that Heru Budi Hartono did not have the guts to uncover the case.

"The problem is that PJ Governor Budi doesn't seem to be brave because he doesn't have the guts to open it, because if it opens it will cause a commotion because it involves many parties because from 2009 the roots are far away, many are enjoying it, officials may also reach political parties," Trubus said in Jakarta, Tuesday, June 13.

According to him, if we look at the many problems and the stalled development in Ancol, especially by PT PJA, we can draw a conclusion if the DKI Provincial Government's asset management is weak in terms of supervision.

"Therefore, it shows the corrupt behavior of the bureaucracy and maybe also in the members of the council, on the one hand also having BUMD people commit acts of violation of the law," he said.

"If you really want to reopen, it's good just open everything in the re-investigation, including Fredie Tan's SP3," he said again.

Trubus also believes that if Heru Budi dares to dismantle the case, a thorough investigation must be carried out. However, he saw that there was an element of intent, making an agreement not to use a notary, if using a notary, it is only a formality which in the end shows corrupt behavior.

"But the realm is indeed in the hands of the governor, because the authority lies with the center. Sofyan Djalil and the previous directors must be processed legally, removed from their positions if they dare," he explained.

Regarding what steps can be taken by the Governor of DKI Jakarta to save Ancol's assets, Trubus suggested carrying out law enforcement, handing over to law enforcement officials (the Attorney General's Office, KPK, police) to conduct a re-investigation.

"It's just that I doubt Heru has political will and political action to uncover the case. Even though he shouldn't be afraid to dismantle this case, because he also only PJ Governor does not have a campaign burden. With the recommendation from the ombudsman, Heru Puji should immediately follow up," he added.

Regarding the findings of the Ombudsman, the existence of an administrative mall in the agreement between PT WAIP as a user of PT PJA's assets and PT MEIS as an international standard stage management company that resulted in the stalled ABC Mall where the stadium was built, according to Trubus, there was an element of intent and they took each other off responsibility.

"And I see that there are even bigger actors involved. Judging from the public side, this case must be resolved immediately, political will and political action, because it is in the hands of the Governor. If you really want to save state assets or people's money as well, the governor can collaborate, coordinate and cooperate with APH as Mr. Mahfud did. There must be courage, PPATK is also involved. The recommendations from this ombudsman have become strong legal evidence to be implemented. So that this does not drag on, PJ Heru Budi must also coordinate with the central government," he explained.

According to him, if left or not allowed, there has been potential state losses because there is maladministration, so there have been billions of state losses since 2009. Corruption in the bureaucracy has always started with maladministration practices, corruption is the aftermath of maladministration, both in the form of procedural irregularities, partiality and other forms of maladministration which then cause losses.

"Although maladiminstration of forms of corruption on a certain scale, corruption is always preceded by intention (intention), will, motive and purpose and opportunity," he said.
