Case Of Fuel Misappropriation, AKBP Achiruddin Hasibuan Sentenced To Free
The panel of judges at the Medan District Court, North Sumatra, acquitted AKBP Achiruddin Hasibuan in a case of alleged misuse of diesel fuel.
"The trial, one, stated that the defendant Achiruddin Hasibuan was not legally and convincingly proven to have committed a criminal act as in the first alternative indictment and the second alternative," said Chief Judge Oloan Silalahi as quoted by ANTARA, Monday, October 30.
The first indictment, Article 55 number 9 paragraph 40 paragraph 5 of the fourth part of Chapter III of Law Number 2 of 2022 concerning Job Creation which has been stipulated into law in accordance with Law Number 6 of 2023 concerning Stipulation of Government Regulation in Lieu of Law Number 2 of 2022, concerning Job Creation into Law in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
The second indictment, Article 53 number 8 Article 40 paragraph 5 of the fourth part of Chapter III of Law Number 2 of 2022 concerning Job Creation in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
The panel of judges stated that the defendant Achiruddin Hasibuan should be acquitted of all charges by the public prosecutor.
"Restoring the defendant's rights in the ability to live in the dignity and dignity of the defendant," said Oloan.
The judge also ordered a number of confiscated evidences, including a box car, a baby tank containing diesel and others returned by the defendant.
The judge's decision is different from the demands of the North Sumatra High Prosecutor's Office which charged AKBP Achiruddin Hasibuan with imprisonment for six years in a case of illegal diesel abuse.
In addition, the prosecutor also demanded that the defendant be subject to a fine of Rp. 50 million, subsidiary to three months in prison.

The prosecutor assessed that the defendant Achiruddin Hasibuan violated Article 55 number 9 paragraph 5 of the fourth part of Chapter III of Law Number 2 of 2022 concerning Job Creation which has been stipulated into law in accordance with Law Number 6 of 2023 concerning Stipulation of Government Regulations in lieu of Law No. 2 of 2022 concerning Job Creation into Law in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
After the trial, North Sumatra Attorney General Randi H. Tambunan said his party would file an appeal.
Meanwhile, Joko Pranata Situmeang, the defendant's legal adviser, said that the panel of judges had handed down the fairest decision for his client.
"We thank you because this decision is as fair as possible for the defendant," he said.
