Ministry Of ATR: Ownership Of Residential Property By Foreigners Increases RI's Competitiveness

JAKARTA - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) revealed that ownership of residences and property by foreign nationals (WNA) in Indonesia can increase Indonesia's competitiveness.

"The government believes that the presence of foreign nationals who carry out activities in Indonesia can increase Indonesia's competitiveness," said Secretary General (Secretary General) of the Ministry of ATR/BPN Suyus Windayana during the Socialization of Residence Regulations for Foreigners in Jakarta as reported by ANTARA, Thursday, August 3.

He said that Indonesia's current condition is still lagging behind in the realization of residential ownership for foreign nationals, especially when compared to other countries such as Singapore, Malaysia, and Thailand.

"Indonesia has great potential to attract foreign market share, because Indonesia has a very large market and very beautiful natural panorama, especially in three destinations, namely Jakarta, Batam and Bali," he said.

By opening the widest possible market, especially for foreign investors to invest in Indonesia. This certainly opens up opportunities for job creation and multiplier effect for improving the national economy.

One of the efforts made by the government is how to make changes or reform regulations through the Job Creation Law as an instrument to encourage economic recovery and transformation.

"The Ministry of ATR BPN which has duties in the field of agrarian and land supports the government's efforts to provide easy housing ownership for foreign nationals, both landed and vertical housing," said Suyus Windayana.

The government through the Ministry of ATR/BPN has issued Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flats Units, and Land Registration, then Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 18 of 2021 concerning Procedures for Determining Rights to Management and Land Rights.

In addition, other regulations that have been issued are the Decree of the Minister of ATR/KBPN No.1241/SK-HK.02/IX/2022 of 2022 Obtaining Housing and Residential/Residential Prices of Foreigners.

Based on these regulations, foreigners who are entitled to own a residence are foreigners who have immigration documents in accordance with the provisions of the legislation.

"Thus, through this provision, it is enough with a passport or visa, foreigners can have property in Indonesia. This is different from the previous regulation where we also asked for a Limited Stay Permit Card (KITAS) and a Permanent Stay Permit Card (KITAP) first, but now it is related to residential ownership for foreigners, KITAS and KITAP will be given after the foreigner buys or gets property in Indonesia," said Suyus Windayana.
