The President Director Explains The Cause Of The Stalled Project In Ancol
JAKARTA - Director of PT Pembangunan Jaya Ancol Winarto explained that four projects stalled in his tourist area, ranging from causes to follow-up to these problems.
This was revealed by Winarto in the DKI Jakarta DPRD Commission B meeting. Winarto reported that there were four problems with stalled projects, ranging from cooperation in apartment construction with Crown, hotel with Marriot Group, development of Sea World with PT Sea World Indonesia, and construction of BTO Music Stadium at ABC Mall with PT Paramitha Bangun Cipta Sarana.
The first project, Ancol, is collaborating on apartment construction with Crown as the developer on April 26, 2018 in the western Ancol area.
However, construction has not yet been carried out, Ancol and Crown actually ended development cooperation on October 20, 2019 because they were not able to develop the property business.
"Not long after the signature of the formation of KSO (operational cooperation), both parties agreed to end this cooperation, it didn't happen, because the property perspectives were both unsure. So, it has been closed on October 20, 2019," said Winarto at the DKI Jakarta DPRD Building, Wednesday, June 21.
Proyek kedua, Ancol dan Marriott Group sempat mengeken kerja sama pembangunan hotel dengan 312 kamar di dalam kawasan Ancol pada 12 Desember 2012.
Building foundations have been locked up, Ancol and Marriott's cooperation has been stopped. Then, Marriott offered a hotel class rebranding to Ancol from Courtyard to Fairfield.
"In 2019, efforts were made to be resolved by both parties on the condition that the termination was through SIAC, and Ancol paid compensation and covered the legality costs. Then this year, a technical and economical feasibility study is being carried out regarding the continuation of the project," explained Winarto.
In the third project, problems occurred in collaboration between Ancol and PT Sea World Indonesia (SWI). In 2011, there was a difference in interpretation between Ancol and PT SWI over build, operate, transfer (BOT) rights to Undersea World Indonesia.
In dealing with this conflict, Ancol and PT SWI sued each other through arbitration, district courts, to the Supreme Court at the cassation level.
"Since 2018, PJA (Ancol) has won all cases at every level of examination until the Supreme Court cassation. So, it has been inkrah, it has been operated by PJA since 2018. Until now it is still operating, all income has entered PJA," explained Winarto.
Then in the fourth project, Ancol entered into a build cooperation agreement, transfer, operate (BTO) Music Stadium at ABC Mall with PT Paramitha Bangun Cipta Sarana (PT PBCS).
However, PT PBCS shifted its company cooperation with Ancol to its affiliate, namely PT Wahana Agung Indonesia Propertindo (PT WAIP). After the construction was completed, BTO assets were handed over from PT WAIP to Ancol on December 20, 2012 and July 31, 2013.

The problem began in 2014, where there was a management dispute between PT WAIP and one of its tenants who managed the concert area in the music stadium building in the name of PT Mata Elang Internasional Stadium (PT MEIS).
"PT MEIS also filed PT PJA (Ancol) as a defendant in several civil lawsuits (pmh). In fact, in this case there was no legal relationship between PT MEIS and PT PJA," he explained.
In dealing with this, Ancol asked for legal opinion from the North Jakarta District Attorney, the Indonesian Attorney General's Office, the Indonesian Ombudsman Representative of DKI Jakarta Province (2020), to the DKI Jakarta High Prosecutor's Office (2022) with the opinion that the takeover of the operation could be carried out after the legal dispute between PT WAIP and PT MEIS was resolved so as not to cause new legal consequences to Ancol.
"The takeover was carried out based on an agreement between PT WAIP and PT PJA which did not harm PT PJA. For the obligation to pay the minimum payment in 2021 and 2022 to PT PJA, a rescheduling agreement has been signed and payments have been made according to the agreement," he added.
