Audi A6 Driver Who Hit A Student In Cianjur To Death Sentenced To 3.5 Years In Prison

CIANJUR- The Cianjur District Court, West Java, sentenced Sugeng Guruh Gautama to 3.5 years in prison, the defendant in the hit-and-run case that killed Selvi Amalia, a Cianjur student.

Chief Judge Muhammad Iman said the panel of judges decided that the defendant Sugeng Guruh Gautama was proven guilty and guilty of committing a criminal act for his negligence in causing the victim to die.

"The defendant was sentenced to three years and five months in prison, reduced to detention and decided that the defendant remained in custody," he said as quoted by ANTARA, Friday, June 16.

The judge gave time for the defendant who was accompanied by his legal advisor and the Public Prosecutor to think about the verdict handed down by the judge for the next seven days.

Meanwhile, judge member Erli Yansah stated the facts at the trial that were revealed, including the defendant who was driving a Audi car to Bandung entering the convoy of Polda Metro Jaya without permission and when crossing the victim did not stop.

"The defendant was also subject to a cumulative article, Articles 310 paragraphs 4 and 312 of Law number 22 of 2009 concerning road traffic and transportation because he did not file an exception. The element of negligence resulted in the victim's death and not providing help and not reporting," he said.

This is in accordance with the indictments of Article 310 paragraph 4 and Article 312 of Law No. 22 of 2009 concerning Road Traffic and Transportation has been legally and convincingly proven, reinforced by the testimony of witness Nur who was in the Audi car.

"Witness Nur felt the car as if it ran over the mound when it ran over the victim, but the defendant did not try to stop the vehicle from making sure. All elements in the indictment have been fulfilled, plus the defendant pleaded not guilty," said Erli.

Meanwhile, the defendant's defense was writtenly rejected because it was not supported by supporting evidence that could strengthen the statement if the defendant did not take any action that caused the victim to die.
