PT Batuah Energi Prima (BEP) has asked the National Police's Criminal Investigation Agency (Bareskrim) to stop the investigation (SP3) regarding allegations of falsification of the company's deed reported by Eko Juni Anto as a former director to the new director Erwin Rahardjo.

Eko is known to have withdrawn his report at Bareskrim. The letter of revocation of the Police Report numbered: LP/B/0754/XII/2021/SPKT/Bareskrim Polri.

Meanwhile, the new board of directors and Eko have also agreed to make peace. The peace deed between the complainant and the reported party has been ratified before the Panel of Judges of the Central Jakarta District Court (Jakpus).

"I ask the Head of the Criminal Investigation Unit of the National Police Headquarters to stop investigating the people I have reported, so that PT. BEP can operate properly, because the problem with PT BEP is currently because it has an impact on the company's operations and has resulted in hundreds of employees unable to work," said Eko in a statement, reported on Friday, June 2.

Furthermore, following up on efforts to revoke the Police Report, Eko sent a letter requesting the termination of the investigation on February 7, 2023.

The letter number 9/NLF-JA/II/2023 was addressed to Bareskrim Polri signed by four attorneys, namely Muhammad Ridwan, Samuel Goklas, Willy Martines Sayoga and Muhammad Reza Adjie Prayogo.

The letter of revocation of the Police Report has also been strengthened through the Peace Deed between Eko Juni Anto as the reporter and Erwin Rahardjo as the reported party, which was ratified before the Central Jakarta District Court Judges on Monday, February 27, 2023.

The Peace Deed contains several settlement agreements. One of them, Eko Juni Anto admitted that Erwin Rahardjo was the legitimate Director of PT Batuah Energi Prima in accordance with the applicable laws and regulations.

Furthermore, Erwin Rahardjo's attorney, Brian Praneda, said that the result of the Police Report had a bad impact on PT Batuah Energi Prima.

The coal mining company, which has a mining permit in Batuah Village, Loa Janan District, Kutai Kartanegara Regency, East Kalimantan Province, is now unable to carry out its activities.

"In order for legal certainty, we hope that the National Police Headquarters will immediately stop the investigation into the Police Report made by Eko Juni Anto because it has been revoked by the person concerned himself. Frankly, our client (PT Batuah Energi Prima) is very disadvantaged because this Police report has had a negative impact on the company's operations. Our client cannot carry out mining operations. Hundreds of employees are currently unable to work, "said Brian.

Brian also mentioned that the letter of application for termination of investigation had been sent to the Criminal Investigation Unit of the Police several times. "And this is possible based on the applicable legal rules in Indonesia," he said.
