Understanding the Land Certificates Write-off and the Terms of Submission

YOGYAKARTA – Communities who want to apply for land certificates but are constrained by costs, need to be familiar with the land certificates write-off. The reason is, this is a program launched by the government so that the less fortunate can take care of land certificates for free.

Understanding the Land Certificates Write-off

Summarized from various sources, the land certificates write-off is a fee waiver program for processing land certificates intended for the less fortunate. This program was launched so that less fortunate people can get legal certainty over the land they own.

The program for land certificates write-off is regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 25 of 2016 concerning Requirements and Procedures for Imposing PNBP Tariffs on Certain Parties.

In the regulation, there are several groups of people who are exempt from the cost of making land certificates, including:

• Poor people
• People who are included in the Government Program in the Simple Housing Sector
• Veterans, retired civil servants, retired military officers, retired police officers, and their husbands/wives/widows/widowers
• Legal entities engaged in the religious and social sectors whose land use is for worship, Islamic boarding schools, orphanages, nursing homes, cultural heritage sites, and places of pilgrimage
• Government agencies and local governments that carry out their duties and functions and are not profit-oriented
• Waqif or the party who endows his property
• Customary law community

Community groups that fall into the above categories do not need to pay any fees for three services, including:

• Measurement and mapping of land parcel boundaries
• Land inspection services by constituency officers
• Land registration for the first time which includes extension or renewal of Cultivation Rights (HGU) and Building Use Rights (HGB).

If you do not belong to the community group above, you can still apply for a land certificate free of charge by joining the Complete Systematic Land Registration (PTSL) program.

PTSL is included in the national priority program which is held simultaneously throughout Indonesia. The program, which was first launched in 2018, is targeted to end in 2025.

Requirements for Submission of Land Certificates Write-off

If you belong to a community group entitled to take part in the land certificate bleaching program, you can apply for a title of land ownership or customary land certificate after fulfilling the following conditions:

• Personal documents in the form of Residential ID Card (KTP) and Family Card (KK)
• Land letter C
• Deed of Sale and Purchase (AJB)
• Proof of payment of land and building rights acquisition fee (BPHTB)
• Proof of Income Tax (PPh) payment
• Proof of payment of Land and Building Tax (PBB)
• Declaration of land/building no dispute
• Attached land boundaries
• Management application letter

Meanwhile, the requirements for obtaining state land certificates include:

• Original KTP and a photocopy that has been legalized by the authorized official
• Family card
• Proof of current year PBB payment,
• Plot Card
• Advice planning
• Building Permit (IMB)
• AJB
• Proof of BPHTB payment
• Proof of PPh payment.
