Pretrial Siskaeee, Polda Metro Expert Disbursed Detention Terms

JAKARTA - Criminal law expert at Krisnadwipayana University (Uncris) Jakarta, Kombes (Ret.) Warasman Marbun said that detention is the investigator's authority by considering formal and material requirements.

This opinion was conveyed in the Sikaeee pretrial hearing regarding the determination of the suspect and the detention of the Polda Metro Jaya.

It started when Siskaeee Gading Simanjuntak's attorney asked questions about the provisions for the detention of a suspect.

It was also mentioned about the provisions if in one case file there were dozens of suspects. However, there are differences in the detention process.

"If there are several suspects whose files are not separated, can only one person be detained from several people who have been named as suspects?" asked Gading during a trial at the South Jakarta District Court, Friday, February 23.

Answering that question, Marbun said that the detention of only one of the suspects could be carried out. Because, it is entirely within the authority of the investigator.

"Investigators to make efforts to force the arrest of detention, who has the authority? It is with investigators," he said.

In detention, investigators also considered subjective and objective requirements. This is contained in Article 21 of the Criminal Procedure Code.

"That's why I explained at the beginning in Article 21 paragraph 1 that is a subjective requirement, while paragraph 2 is an objective requirement. So it depends on the investigator," said Marbun.

Meanwhile, Siskaeee was detained a day after being arrested in an apartment in the Yogyakarta area, on January 24, 2024.

Investigators will then extend the detention period for Siskaeee for the next 40 days.

"Currently, further detention is being carried out, yes, in the next 40 days. So at this time, suspect S is still being held for investigation purposes at Polda Metro Jaya," said Head of Public Relations of Polda Metro Jaya Kombes Ade Ary Syam Indradi.

The extension of the detention period is because investigators have not finished compiling the case file for the porn film production house which made Siskaeee one of the suspects.

When the case file is completed, the investigator will delegate it. Then, if it is declared complete, then, stage two or transfer of the suspect and evidence will be carried out.
