JAKARTA - Residents of Kampung Bayam sued the DKI Jakarta Provincial Government and PT Jakarta Propertindo to the Jakarta State Administrative Court (PTUN) because they still could not occupy Kampung Susun Bayam.

Kampung Susun Bayam was founded by former DKI Jakarta Governor Anies Baswedan for residents of Kampung Bayam who were evicted due to the construction of the Jakarta International Stadium (JIS). Since its inauguration in October 2022, residents have not been able to occupy Kampung Susun Bayam.

Representative of the Brotherhood of the Residents of Kampung Bayam (PWKB) from LBH Jakarta, Jihan Fauziah Hamdi said, this lawsuit was filed by residents of Kampung Bayam because they had never received the right to the unit to inhabit and manage the Kampung Susun Bayam.

"This lawsuit asks the Administrative Court to order Jakpro and the DKI Jakarta Provincial Government to immediately provide the Kampung Susun Bayam unit to the residents of Kampung Bayam as clear is the basis through the Governor Decree of DKI 979/2022 and North Jakarta Mayor's Letter number e-0176/PU.04.0," said jihan in his statement, Monday, August 14.

Jihan explained a number of reasons why the residents of Kampung Bayam finally sued the DKI Jakarta Provincial Government. First, settlements in the Kampung Bayam area of Jalan Sunter Permai Raya, Jakarta International Stadium RW 12, Papanggo Village, Tanjung Priok District, North Jakarta are evicted residential areas.

The basis of residents occupying Kampung Susun Bayam has also gone through a verification process as stated in the North Jakarta Mayor's Letter number e-0176/PU.04.00 regarding Verification Data for Candidates for Bayam Village Residents.

Second, the DKI Jakarta Provincial Government and Jakpro violate the rights of the residents of Kampung Bayam because residents have never had access to housing.

"Approachment by the DKI Provincial Government and Jakpro has had an impact on uncertainty in fulfilling the right to a proper place to live. As a result, residents must live adrift, even 5 of them have to camp in front of Kampung Susun Bayam because they no longer have money to rent or look for other places to live," explained Jihan.

Third, Jihan views that the actions of the DKI Jakarta and Jakpro Provincial Governments have violated the general principles of good governance (AUPB). In addition to legal uncertainty that must be faced by residents of Kampung Bayam, the DKI Provincial Government and Jakpro are also considered to have violated the principles of openness, benefit, impartiality and public interest.

"Instead of giving the residents of Kampung Bayam an opportunity to have their opinion heard, Jakpro actually gave tariffs to the residents of Kampung Bayam which contradicted the laws and regulations, based on the use of Pergub DKI 55/2018," explained Jihan.

"In fact, it is clear that the residents of Kampung Bayam are residents with the category of programmed groups and residents who are entitled to the unit by being listed in the DKI Kepgub 979/2022 scheme, even strengthened by verification of citizen data as stated in the Decree issued by the Mayor of North Jakarta," he added.
