鉄砂鉱山汚職容疑者の公判前訴訟を棄却する裁判官

The sole judge at the Mataram District Court, West Nusa Tenggara rejected the pretrial lawsuit with applicant Zainal Abidin, one of the suspects in corruption in the iron sand mining activity of PT Anugrah Mitra Graha (AMG) in the Dedalpak Block, East Lombok Regency.

"To try, reject Zainal Abidin's pretrial application in its entirety," said single judge Glorious Agundoro reading out the verdict at the Mataram District Court, Monday.

The judge also conveyed his considerations in making the decision. One of them saw the evidence presented by the respondent, in this case the NTB Prosecutor's Office.

The evidence is in the form of confiscated documents, witness statements, and statements of state losses worth Rp. 2 billion from the testimony of the NTB Representative BPKP Investigation Korwas.

Therefore, the judge assessed that Zainal Abidin, the former Head of the NTB Energy and Mineral Resources Service (ESDM) as one of the suspects in the case, was in accordance with legal procedures.

"The two pieces of evidence presented by the respondent in determining the applicant (Zainal Abidin) as a suspect are legal," he said.

The pretrial application submitted by Zainal Abidin is registered at the Mataram District Court with the number: 4/Pid.Pra/2023/PN Mtr, dated April 13, 2023.

In the description of the petitum, Zainal Abidin stated that the NTB Prosecutor's Office did not/not enough evidence.

Likewise with the application of the alleged Article 2 paragraph (1) and/or Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code, it is considered invalid and not based on law.

By stating this in the petitum, Zainal Abidin assessed that his determination as a suspect by the prosecutor's office did not have binding legal force.
