Case Of Malili River Pollution PT CLM, Observer: Divpropam Polri Examines East Luwu Police Chief

JAKARTA - Legal observer Fajar Trio questioned the attitude of the East Luwu Police who did not process reports from residents regarding the Malili River pollution case allegedly carried out by PT CLM version Zainal Abidin Siregar. He also urged Kompolnas to the Divpropam Police Headquarters to intervene in this condition.

"If the East Luwu Police do not follow up on public reports, then they have the potential to violate Article 15 of the National Police Chief Regulation Number 14 of 2011 concerning the Police Professional Code of Ethics. For this reason, the reporter can report this case to the National Police Divpropam and Kompolnas, to examine the East Luwu Police Chief," Fajar said in Jakarta, Tuesday, May 2.

Fajar said that in this article, every member of the National Police is prohibited from rejecting or ignoring requests for help, assistance, or reports and complaints from the public which are the scope of their duties, functions and authorities.

He also gave a special note to the East Luwu Police because previously it had gone viral with the hashtag #PercumaLaporPolisi.

"It should reflect on the viral case, the East Luwu Police can introspect and improve themselves, because if they reject public reports, the bad name is General Listyo Sigit as the National Police Chief and tarnish the dignity of the Bhayangkara corps," he said.

It is known that the hashtag #PercumaLaporPolisi echoed on Twitter as a form of reaction to the termination of the investigation into the rape case of three children by the biological father in Malili District, East Luwu Regency, South Sulawesi.

Previously, dozens of people who were members of the Malili Youth and Community Alliance held a demonstration in front of the East Luwu Regency DPRD office protesting against the pollution of the Malili River which was allegedly carried out by the Zainal Abidin Siregar version of PT CLM on Friday, April 28, 2023.

The mass coordinator, Malik, said the action was carried out because the current condition of the Malili River water was cloudy and no longer as clear as it used to be.

"The water is cloudy and can no longer be used for washing and drinking," said Malik.

According to him, the government must summon all mining companies to explain where their waste was disposed of and if it can be socialized to the public.

"This action is also only as a lighter and there is a plan for further action," he said.

Meanwhile, the National Coordinating Board for the Islamic Student Legal Consultation and Aid Institute (Bakornas LKBHMI) PB HMI, previously reported PT CLM to the Directorate General of Law Enforcement of the Ministry of Environment and Forestry (Ditjen Gakkum KLHK).

Deputy Executive Director of Bakornas LKBHMI PB HMI, Ibrahim Asnawi said that the report was related to allegations of permit and pollution and/or environmental destruction due to PT CLM's nickel mining activities operating in Malili District, East Luwu Regency, South Sulawesi Province.

"We have an obligation to protect and preserve our environment. Everyone has the right to get a good and healthy environment, it is a human right guaranteed in Article 28 H Paragraph (1) of the 1945 Constitution of the Republic of Indonesia. We hope that the Ministry of Environment and Forestry will follow up on this report," said Ibrahim.

Bakornas LKBHMI PB HMI pun mendesak Gakkum KLHK untuk melakukan penegakan hukum secara serius dan komprehensif untuk menindak tegas dugaan adanya kerusakan lingkungan yang diakibatkan oleh aktivitas penambangan nikel PT CLM.

According to him, PT CLM, which is now controlled by Zainal Abidin Siregar, can be criminally charged and administrative sanctions as regulated in Law Number 32 of 2009 concerning Environmental Protection and Management (UPU PPLH) as well as in Law Number 19 of 2004 concerning Forestry.

Previously, it was reported that PT CLM was experiencing a share ownership conflict involving the Deputy Minister of Law and Human Rights EOSH. The case itself has been reported by the Indonesia Police Watch (IPW) to the KPK.
