Agung Sedayu Reveals HGB In Pagar Laut Tangerang: Formerly Land Of Tambak
JAKARTA - Agung Sedayu Group explained, regarding ownership certificates (SHM) and building rights certificates (SHGB) in the Tangerang waters sea fence area, Banten.
They said that the title certificate (SHM) and building rights certificate (SHGB) owned by their subsidiaries were mainland and have now become the sea due to abrasion factors.
Attorney Agung Sedayu Muannas Alaidid said that his party had checked the certificate submission documents issued in 1982, namely the sea fence which used to be land.
He claimed that the land around the sea fence area of Kohod Village used to be used as ponds or rice fields that had been abrasion.
"That's right, ponds and rice fields used to be salted, not the sea. Strengthened by Regional Regulation (Perda) Number 1 of 2023 it is also stated that the location where PT is designated as land," he said through an official statement received by VOI, Friday, January 24.
Then, Muannas said, the land around the sea fence also contained SHM belonging to other residents.
He claimed the land was purchased from the people.
"The rest belonged to 9 individuals and it is reported that 17 SHM fields were also found in the area. However, the SHM has nothing to do with PIK 2," he said.
On the other hand, Muannas emphasized that the SHGB obtained by the Pantai Indah Kapuk Dua Tbk (PANI) subsidiary was in accordance with the process and procedures. In fact, his party has obtained a approval permit for the Compliance of Marine Spatial Utilization Activities (PKKPRL).
"HGB was obtained according to the process and procedure of buying and selling from the people in the form of SHM according to the girik issued in 1982 and reversed its official name by paying taxes and there is a SK for location/PKKPRL permits as a pond area and rice fields," he concluded.
Previously, Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Nusron Wahid said the HGB certificates to SHM letters in Tangerang Regency, Banten, were materially flawed.
"We view that the certificate that is off the coastline is a defective procedure, a material defect," Nusron told reporters in Tanjung Pasir, Teluknaga, Tangerang Regency, Wednesday, January 22.

According to Nusron, the HGB to SHM certificates are said to be procedural defects because the beach is a public land that should not be certified.
"If, oh my, he is in the form of land. Moreover, this shape is not soil. So, it is uncertified," he said.
The mysterious 30.16-kilometer marine fence in Tangerang Regency, Banten, annexed the coastal areas of dozens of fishing villages in 6 sub-districts.
This also makes it difficult for fishermen to find fish.
Until now, the existence of the sea fence still creates mystery and polemics.
