Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD said the change in norms in the Election Law based on the decision of the Constitutional Court (MK) could apply in 2024 or the 2029 election, or depend on the decision of the constitutional judge.

Mahfud said he would submit the results of the judicial review of Law Number 7 of 2017 concerning General Elections on the decision of the Constitutional Court judge.

"It's up to the judge. It can be both (actions in the 2024 General Election and the 2029 General Election), but what kind of wisdom of judges is it," Mahfud said after giving a scientific oration at the Dies Natalis, University of Pancasila in Jakarta, reported by ANTARA, Thursday, November 9.

According to him, the Constitutional Court judge could also decide not to accept the lawsuit against the change in norms in the Election Law regarding the requirements to become a presidential and vice presidential candidate.

"It could be NO's decision (niet ontvankelijke verklaard), meaning that it will not be prosecuted again," he explained.

Changes in norms in the Election Law, he continued, could also be applied in the future.

"It depends on the judge. Politically, what is the situation? What is our ability to do?" he said.

Previously, Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie said that the decision of Law Number 7 of 2017 concerning General Elections would apply to the 2029 General Election.

Jimly said the Constitutional Court's decision was final and binding. However, the norms in Article 169 letter q that have changed as decided by the Constitutional Court Number 90/PUU-XXI/2023 can be tested for material again.

Jimly emphasized that the rules related to the age requirements for presidential and vice presidential candidates in the 2024 election have been completed.

Therefore, he invited the public not to debate the rules of the game anymore.
