DKPP Rejects Bawaslu Complaints Against KPU Regarding Alleged Restrictions On Election Stages Supervision

JAKARTA - The Election Organizers Honorary Council (DKPP) rejects the Election Supervisory Body (Bawaslu) complaint in the case Number 106-PKE-DKPP/VIII/2023 against the General Election Commission (KPU) which allegedly limits supervision and implements the election stages beyond schedule.

"Decided that, one, (DKPP) rejects the complainants' complaints in its entirety," said DKPP member Ratna Dewi Pettalolo in the trial of reading the case decision Number 106-PKE-DKPP/VIII/2023 as reported by ANTARA, Wednesday, October 25.

He also said that DKPP decided to rehabilitate the good name of KPU Chairman Hasyim Asy'ari and other KPU members since the verdict was read out.

Ratna said the KPU had to carry out the decision no later than seven days after the decision was read. Meanwhile, according to him, Bawaslu was asked to oversee the implementation of the decision.

Ratna said that apart from herself, the decision regarding Case Number 106-PKE-DKPP/VIII/2023 was taken in a plenary meeting by four other DKPP members, namely Heddy Lugito, J. Kristiadi, Muhammad Tio Aliansyah, and I Dewa Kade Wiarsa Raka Sandi on September 27, 2023.

This is based on various facts revealed in the trial from the statements of the complainants, answers to the defendants, submitted evidence, as well as statements from witnesses and experts.

Meanwhile, in the part of the conclusion read out by DKPP member Muhammad Tio Aliansyah, the council concluded that the defendants were not proven to have violated the code of ethics and code of conduct for general election organizers (elections).

Previously, in the petition hearing on the examination of alleged violations of the election organizer's code of ethics at the DKPP Office, Jakarta, Monday (4/10), Bawaslu asked the DKPP to temporarily suspend the chairman and members of the KPU.

Bawaslu complained about the KPU in two respects in case Number 106-PKE-DKPP/VIII/2023, namely the KPU allegedly limiting Bawaslu's supervisory duties as stipulated in Article 93 letter d number 4 of Law Number 7 of 2017 concerning General Elections.

This task is also regulated in Bawaslu Regulation (Perbawaslu) Number 8 of 2023 concerning the supervision of the candidacy of Members of the House of Representatives, Provincial House of Representatives, and the Regional People's Representative Council of Regency/City, as well as Perbawaslu Number 5 of 2022 concerning supervision of the implementation of general elections.

Second, the KPU was also complained by Bawaslu for allegedly carrying out stages outside the program and schedule of the election stages as stipulated in the provisions of the Election Law and Regulation of the General Election Commission Number (PKPU) Number 3 of 2022 concerning the Stages and Schedules for the Implementation of General Elections.

Then, PKPU Number 10 of 2023 concerning the Nomination of Members of the House of Representatives, Members of the Provincial Regional House of Representatives, and Members of the Regional House of Representatives.
