List Of MKMK Members Who Will Investigate Alleged Ethical Violations In Decision Of Vice Presidential Terms

YOGYAKARTA There are three figures who are included in the MKMK or the Honorary Council of the Constitutional Court. The three of them will follow up on reports related to alleged violations of the code of ethics of constitutional judges, especially in Case Decision No. 90/PUU-XXI/2023 concerning the minimum age requirements of presidential and vice presidential candidates.

"We comply with this with the provisions in Article 27A of the Constitutional Court Law (Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003) concerning membership (MKMK)," said Constitutional Court Judge (MK) Enny Nurbaningsih at a press conference held at the Constitutional Court Building, Jakarta, Monday 23 October.

MKMK members themselves consist of figures with different backgrounds, namely community leaders, academics, and active judges. Based on the meeting that was held by the Constitutional Court judge, there were three members of the Constitutional Court, namely as follows.

Constitutional Court Judge Enny Nurbaningsih also briefly explained the profile of each member of the Constitutional Court who had been chosen, namely as follows.

Enny explained that Jimly Asshiddiqie was appointed as a member of the MKMK because of his credibility. It is known that he had sat on the chair of the Chairman of the Indonesian Constitutional Court in the 2003-2008 period. In addition, he was once the Chairman of the Honorary Council of General Election Organizers (DKPP) for the 2012-2017 period.

"I don't think we need to doubt his (Jimly) credibility anymore," said Enny.

Currently Jimly serves as a member of the Regional Representative Council (DPD) of the Republic of Indonesia from the Electoral Region (Dapil) of DKI Jakarta.

Bintan Siragiah is a figure who represents an academic group. He is a senior advisor to the Faculty of Law, Pelita Harapan University (UPH). Bintan has served as a member of the Constitutional Court Ethics Council from 2017 to 2020.

"He used to be a member of the Constitutional Court Ethics Council. However, because his current institution is the MKMK, it allows him to become a member of the MKMK," he explained.

Wahiduddin Adams is a figure who is currently still an active constitutional judge in the Constitutional Court. His position as a constitutional judge has been carried out for two terms, namely in the 2014-2019 and 2019-2024 periods. During his duties, Wahiduddin received an award, namely the Main Mahaputera Star which was handed over by President Joko Widodo on November 11, 2020.

The task of the Honorary Council of the Constitutional Court or MKMK which is currently being formed is to conduct an examination of alleged ethical violations committed by Chief Justice of the Constitutional Court Anwar Usman in decision Number 90/PUU-XXI/2023.

In this case, the Constitutional Court is known to have granted some requests for judicial review of Law no. 7 of 2017 concerning Elections regarding the age limit for presidential and vice presidential candidates which were changed to 40 years old or experienced as regional heads.

Regarding the decision, Enny himself said that currently there are seven reports that have entered the Constitutional Court from various community groups and advocates, one of which comes from the Election Care Advocacy Team.

In the report, it is considered that Anwar allegedly committed an ethical violation because he participated in examining and deciding the case of the presidential and vice-presidential age limit. This effort is considered a step to fight for the political interests of Surakarta Walkot Gibran Rakabuming, who is none other than his own nephew.
