AGO: Only Mario Dandy-Shane Lukas Is Charged With Paying Restitution

The Attorney General's Office (AGO) said that only the defendants Mario Dandy Satriyo and Shane Lukas were charged with paying restitution or compensation in the case of David Ozora's persecution of Rp120 billion. Meanwhile, AG's child was not charged.

"AG is not (charged with restitution) because he is still a child," said the Head of the Attorney General's Office, Ketut Sumedana, quoted on Saturday, August 19.

Even though it was not charged, the file on the demands of AG's child's name was still listed regarding the payment of restitution. This is because he was involved together in a series of cases of persecution of David Ozora.

"We include him jointly causing a loss," he said.

The prosecutor fully handed over to the panel of judges regarding the distribution of the value of restitution for each defendant. Most importantly, said Ketut, the rights of the victim can be fulfilled.

"The judge will consider. Whether the Rp120 billion is divided according to the shared responsibility with different classifications, whether he is together, or the same as the same portion. I think the judge is wiser," said Ketut.

Previously, Ketut also had time to convey the reason for burdening the defendant with Rp120 billion in restitution because there were calculations of material and immaterial losses.

The material loss in question is the costs that have been incurred by the family during David Ozora's treatment. Meanwhile, immaterial is a loss that will occur in the future.

It is known, as a result of the abuse, David Ozora suffered brain damage. In fact, it is said that it is unlikely to be able to recover as usual.

"We are demanding because we estimate that in addition to material losses, the money losses incurred in the context of treatment and treatment are also considered as immaterial losses," said Ketut.

In the trial of the alleged abuse case of David Ozora, the prosecutor charged Mario Dandy Satriyo with imprisonment for 12 years. In addition, Rafael Alun Trisambodo's son was burdened with paying restitution of Rp120 billion.

If Mario is unable to pay, then, there is an additional sentence in the form of imprisonment for 7 years

Meanwhile, the defendant Shane Lukas was charged with a lower sentence of 5 years in prison. He is also burdened with restitution payments. However, if not able to be replaced with 6 months in prison.
