Deputy Minister Of Law And Human Rights Asks Jokowi To Change Presidential Decree For The Term Of Office Of KPK Leaders

JAKARTA - Deputy Minister of Law and Human Rights (Wamenkumham) Edward Omar Sharif Hiariej assessed that President Jokowi Widodo must immediately change the presidential decree (keppres) regarding the term of office of the head of the Corruption Eradication Commission (KPK) after the Constitutional Court (MK) granted the lawsuit related to this.

The Constitutional Court granted all the contents of Nurul Ghufron's lawsuit regarding the term of office of the KPK leadership from four years to five years.

"If we look at the information from the Constitutional Court today, it means that the president must immediately change the president's decision regarding the ( term of office) of the KPK leadership, which four years into this decision, was extended by one year," said Edward Omar Sharif Hiariej after attending the Kumham Goes to Campus 2023 activity at the Faculty of Law, Universitas Airlangga Surabaya, East Java, Friday, May 26, confiscated by Antara.

Regarding the implementation of the decision for the current period, Edward assessed that the Constitutional Court needed to provide an explanation of the reasons for the implementation of the decision so as not to cause controversy in the community.

Previously, MK spokesman Fajar Laksono said the decision of the Constitutional Court panel of judges which extended the term of office of the KPK leadership was valid for the 2019-2023 period.

Considerations regarding the implementation of Decision 112/PUU-XX/2022 for KPK leaders are currently listed in the considerations read out by the panel of judges.

The panel of judges at the Constitutional Court considers the current term of office of the KPK leadership which will end on December 20, 2023, which is only six months away. The panel of judges at the Constitutional Court considered it important to provide legal certainty and fair benefits.

Therefore, the Constitutional Court immediately decided the case in order to provide certainty of the term of office of the KPK leadership for this period. The Constitutional Court also decided to change the term of office of the KPK leadership from four years to five years.

"As regulated in the Constitutional Court Law, decisions apply and have binding force since it is finished pronounced in the plenary session of the pronouncement of the verdict," said Fajar.

Apart from the KPK leadership, Fajar also said that the 112/PUU-XX-2022 decision regarding changes in the term of office to five years also applies to the KPK Supervisory Board, which currently also has a duration of four years.

"The change in the term of office to five years also applies to the KPK Supervisory Board," he said.
