Losing A Dispute With A Customer, The Kudus District Court Confiscates The Jiwasraya Insurance Office On Jalan Pramuka

KUDUS - The District Court (PN) of Kudus Regency, Central Java, carried out its decision to confiscate the Jiwasraya Insurance Office, Jalan Pramuka, Kudus Village. The confiscation was related to a dispute between the insurance company and its customer as the plaintiff.

The execution was led by the Head of the District Court of Kudus Singgih Wahono‎ after the plaintiff Stevian Arifanto (‎38), a resident of Semarang, won the lawsuit against Defendant I Diyah Yuliastina as an insurance agent and Defendant II PT Asuransi Jiwasraya because they were considered against the law.

"The execution of a 1,230 square meter building belonging to Asuransi Jiwasraya follows the existence of permanent legal force from the Supreme Court Number 2920K/Pdt/2020 on Stevian Arifanto's lawsuit," said Kudus District Court Registrar Burhanudin in Kudus, Antara, Friday, April 22.

During the confiscation, he said, the building may not be transferred. The land has the status of Building Use Rights (HGB) Number 7 in Mlati Kidul Village, City District, Kudus Regency, which will expire on November 2, 2041.

Plaintiff Stefiano Arifianto revealed that the lawsuit began when he became a priority customer in the insurance and wanted to apply for policy disbursement in 2017.

"It turned out that it couldn't be disbursed. Initially, the policy that I disbursed was more than Rp. 25 billion. In the course of time, only Rp. 4 billion was disbursed, the remaining Rp. 20.86 billion could not be paid until now," he said.

The civil lawsuit, he said, had been registered with the Kudus District Court since 2018 until the Supreme Court's decision on the cassation level. The judge granted the plaintiff's claim in cash and at once in the amount of Rp20.8 billion which was decided on November 4, 2020.

Because there was no good faith from the insurance company, the plaintiff finally filed for the execution of the guarantee confiscation.

At the door of the Jiwasraya Kudus Insurance Office, a banner was attached that said that the insurance office had now been confiscated by the Kudus District Court.
