Edy Mulyadi Prepares To Be Arrested But Requests Suspension Of Detention

JAKARTA - Social media activist, Edy Mulyadi, has been named a suspect and detained in a case of alleged hate speech about Kalimantan where the genie dumped their child. In fact, Edy had predicted it all.

The prediction was made when Edy Mulyadi will undergo an examination on Monday, January 31. He had also prepared a set of clothes in a yellow bag.

"I brought this here," said Edy Mulyadi, showing the yellow bag to reporters at the National Police Criminal Investigation Unit.

Edy Mulyadi then spoke about his apology to the people of Kalimantan, his refusal to move the new state capital to East Kalimantan to the exploitation of Kalimantan's resources without benefiting the people of Kalimantan.

"Yes, I suspect (immediately arrested, ed). But I didn't expect it," said Edy Mulyadi about his hunch.

His prediction was proven, after several hours of the investigation process, the Police finally announced that Edy Mulyadi was named a suspect and detained.

Karo Penmas, Police Public Relations Division, Brigadier General Ahmad Ramadhan, said the determination of the suspect was based on the results of the case title and a series of processes for examining witnesses and experts.

"After the case is carried out, the investigator has upgraded the status from witness to suspect," said Ramadhan.

In addition, investigators also decided to detain Edy Mulyadi for the next 20 days.

"Against EM's brother (Edy Mulyadi) investigators made arrests and continued detention," he said.

The detention of Edy Mulyadi for two reasons, namely objective and subjective investigators. One of the investigators was worried that Edy Mulyadi would destroy evidence.

"Subjective reasons are fear of escaping, fear of losing evidence, fear of repeating his actions, objective reasons of the threat being imposed for more than 5 years," said Ramadhan.

In this case, Edy Mulyadi was threatened with imprisonment for 10 years. This is because he is suspected of violating multiple articles, including Article 45 a paragraph 2 in conjunction with 28 paragraph (2) of the Electronic Information and Transactions Law (ITE).

Then, Edy Mulyadi was also suspected of violating Article 14 paragraphs (1) and (2) of the Criminal Code in conjunction with Article 15 of Law Number 1 of 1946 concerning criminal law regulations, and Article 156 of the Criminal Code.

Shortly after the detention, Edy Mulyadi's attorney, Damai Hari Lubis, took immediate action. He said he would apply for a suspension of detention.

"Based on the legal considerations of the presumption of innocence, our advocacy team as lawyers and defenders will apply for a suspension of detention in accordance with the requirements of the applicable legal system or the Criminal Procedure Code," said Damai.

In addition, Damai regretted the investigator's decision to detain Edy Mulyadi. The reason is that the subject matter reported is just a satire.

"I deeply regret the detention of EM due to alleged violations other than debatable because the object of the case is related to art space or language of expression or satire, or is a satirical language in an area according to customs and culture or Betawi customs and is not disclosed with dirty or harsh sentences," he said.
