LPSK: Brigadier J's Family Can Apply For Restitution
JAKARTA - The Witness and Victim Protection Agency (LPSK) stated that the families of victims of Brigadier Nofriansyah Yosua Hutabarat or Brigadier J could apply for restitution after the decision of the Supreme Court (MA).
"On this decision, the LPSK is of the view that the victim's family / heirs actually have the right to apply for restitution / compensation to the convicts," said LPSK Deputy Chairman Maneger Nasution in a written statement reported by ANTARA, Thursday, August 10.
Maneger Nasution explained that Supreme Court Regulation Number 1 of 2022 has regulated the procedural law regarding the application for restitution after a decision has permanent legal force (inkrah).
The procedure for submitting the application can be submitted by the applicant / victim's heir or through LPSK.
Nasution emphasized that the decision was returned to the victim's family whether they had the desire to apply for restitution because restitution was the right of the victim/the victim's family.
"Decisions will whether or not to apply absolutely are their rights," he said.
The application through the mechanism for determining the application, he said, was limited by Perma Number 1 of 2023 and only 90 days after the applicant found out that the court's decision had permanent legal force.

The Supreme Court (MA) has decided the cases of the defendants in the premeditated murder case of Brigadier J, namely Ferdy Sambo, Putri Candrawati, Ricky Rizal Wibowo, Strong Ma'ruf on August 8, 2023.
The Supreme Court's sentence was handed down against Ferdy Sambo to life imprisonment, Putri Candrawati and Strong Ma'ruf to 10 years in prison, and Ricky Rizal Wibowo was sentenced to 8 years in prison.
"With regard to the decision, LPSK respects the Supreme Court's decision which has permanent legal force," he said.
