Leaked Information On The Constitutional Court's Decision Agreeing To Closed Proportional Elections, Mahfud MD Asks Police To Investigate Source Denny Indrayana
JAKARTA The alleged disclosure of information on the decision of the Constitutional Court (MK) regarding the Legislative Election (Pileg) system has attracted the attention of many parties among the political elite and government officials. This is because the Constitutional Court's decision which has not been read is a state secret.
The alleged leak led the Coordinating Minister for Political, Legal and Security Affairs (Menkopolhukam) Mahfud MD to ask the police and the Constitutional Court to conduct an investigation.
"Regardless of anything, the Constitutional Court's decision should not be leaked before it is read. Denny's information is a bad precedent, it can be categorized as leaking state secrets. The police must investigate A1's information which is said to be a source of Denny so that it does not become speculation that contains slander," said Mahfud MD, Antara, Sunday, May 28.
Mahfud even said that he, who had served as Chief Justice of the Constitutional Court, did not dare to ask the Constitutional Court about decisions that had not been read. He also urged the Constitutional Court to look for parties who leaked the information.
"The Constitutional Court's decision was a strict secret before it was read, but it had to be widely disclosed after it was decided by placing the verdict at the official and open trial. I, the former Chief Justice of the Constitutional Court, did not dare to ask for a signal, let alone ask about the Constitutional Court's verdict which had not been read out as an official verdict. The Constitutional Court must investigate the source of the information," Mahfud said in his tweet.
Previously, former Deputy Minister of Law and Human Rights (Wamenkumham) Denny Indrayana claimed to have received information about the decision of the Constitutional Court (MK) regarding the legislative electoral system that would return to a closed proportional system or party voting.

"This morning I received important information. The Constitutional Court will decide on the legislative election to return to a closed proportional system, again choosing a party image mark," Denny said via a tweet on his Twitter account @dennyindranaya, Sunday.
In his tweet, Denny also mentioned the source in the Constitutional Court. Although Denny did not clearly answer, he confirmed that the source was not a constitutional judge.
"Who is the source? The person I really trust is credibility, who is definitely not a Constitutional Judge," he said.
"So, we are returning to the New Order election system: authoritarian and corrupt," Denny said in his tweet.
Meanwhile, the Constitutional Court (MK) has received a request for judicial review of Article 168 paragraph (2) of the Election Law related to an open proportional system registered with case registration number 114/PUU-XX/2022 on November 14, 2022. The six applicants are Demas Brian Wicaksono (Pemohon I), Yuwono Pintadi (Pemohon II), Fahrurrozi (Pemohon III), Ibnu Rachman Jaya (Permohon IV), Riyanto (Pemohon V), and Nono Marijono (Pemohon VI). Eight of the nine political party factions in the DPR RI also stated that they rejected a closed proportional electoral system, namely the Golkar, Gerindra, Democrat, NasDem, PAN, PKB, PPP and PKS factions. Only one faction wants a closed proportional electoral system, namely the PDI-P.
