Wins Lawsuit, Government Forms Self-Managed Team For Sultan Senayan Hotel Land

JAKARTA - The Ministry of State Secretariat (Kemensetneg) formed a Block 15 Management Transition Team for the Bung Karno Gelora Complex Management Center (PPK GBK) or the Sultan Hotel building.

This was followed by the decision of the Reconsideration (PK) of the land dispute Block 15 of the Bung Karno Gelora Area won by the government from PT Indobuildco. Furthermore, the government through the Ministry of State Secretariat will manage the area itself.

The Deputy Minister of Law and Human Rights added that management will be in line with the government's plan to revitalize the GBK area for the benefit of the state, both sports and non-sports, as well as various state and international activities.

On the same occasion, the Secretary of the Ministry of State Secretariat, Setya Utama, said that the formation of the transition team was a decision from the Minister of State Secretary (Mensesneg) Pratikno.

"The leader has decided with the end of HGB No.27/Gelora and No.26/Gelora will manage it themselves, so Kemensetneg will manage its own, in this case PPK GBK," said Setya.

Setya also conveyed that according to applicable regulations, management can be collaborated with other parties who are considered to have competence in managing areas, hotels, and assets on HPL No. 1/Gelora, including Block 15 or currently occupied by Hotel Sultan.

According to Setya, the Ministry of State Secretariat and PPK GBK will further explore the management plan of Block 15 HPL 1/Gelora starting with physical checks and audits from the Financial and Development Supervisory Agency (BPKP) and the Public Appraisal Service Office (KJPP).

"And we will work together with the Ministry of Finance to find the best cooperation model to get the most optimal benefits for the assets of this country," he said.

Meanwhile, Eddy said that the transition team also invited PT Indobuildco, as the party who had been in dispute over the Sultan Hotel land or Block 15 HPL No.1/Gelora, to discuss further on Tuesday 7 March 2023.

"We, the Ministry of State Secretariat and PPK GBK, in good faith invited PT Indobuildco to discuss this on Tuesday 7 March 2023 at 13.30 (WIB). So what will happen in the future, we will explore it on Tuesday (7/3) tomorrow," said Eddy.

Eddy reiterated that the Sultan Hotel area or Block 15 is above HPL No.1 Gelora and is legally owned by the state through the Ministry of State Affairs based on the decision to Review Civil Case Number 276PK/Pdt/2011 dated November 23, 2011 (PK 1).

Then the PK 1 decision, continued Eddy, has been upheld by the Supreme Court (MA) in three decisions on the next three PK lawsuits filed by PT Indobuildco including PK 4 which were decided on June 21, 2022.

On the other hand, the facts of the trial prove land acquisition through the Asian Games Liberation Affairs Command (KUPAG) in 1962 and based on Presidential Decree Number 4 of 1984 concerning the Senayan Sports Center Management Agency at the First Dictum stated that all the land and buildings along with the results of development or development in the Asian Games area are state property, in this case the Ministry of Finance.

This was then strengthened by the Decree of the Head of the National Land Agency (BPN) Number 169/HPL/BPN/1989 which stated that HGB a.n. PT Indobuildco was above HPL No.1/Gelora.

Meanwhile, in the decision on the civil case of the South Jakarta District Court No.952/Pdt.G/2006 dated January 29, 2007, former DKI Jakarta Governor Ali Sadikin also testified that he thought PT Indobuildco was a subsidiary of Pertamina, but it turned out to be privately owned. Ali also felt cheated because he had given permission to use state-owned land to private companies.

Furthermore, Eddy also stated that during the 2007-2023 period, PT Indobuildco did not pay royalties / contributions to the state at all.
