Attorney General: Corporate Criminalization Considers Economic Stability
JAKARTA - Attorney General Sanitiar Burhanuddin said that the punishment of corporations, especially the sanctions for closing corporations, should be carried out carefully by considering economic stability and business continuity.
"Criminalization of corporations, especially sanctions for closing corporations, should be carried out carefully, carefully and wisely because the impact is very broad," said Burhanuddin in a written statement quoted by ANTARA, Friday, August 19.
According to him, do not let corporate punishment cause innocent people, such as workers, shareholders, consumers, and parties who depend on corporations, including the government, to become victims as the aggrieved parties.
Burhanuddin said that the most appropriate criminal sanctions to be applied to corporate legal subjects are optimizing the return or recovery of losses that arise as a result of corporate criminal acts, as well as re-creating the harmonization of life in society that was previously torn apart by corporate crimes.
In addition, Burhanuddin said that the punishment of corporations as perpetrators of criminal acts also considers the realization of economic stability and anticipates crises in various fields as a result of criminal acts committed by corporations.
"Hopefully in the future, corporate criminal responsibility in Indonesia can be carried out with an integral law enforcement approach to achieve transformative justice," he said.
In the perspective of integral law enforcement, corporate punishment is more directed at achieving transformative justice where conflicting parties provide justice to each other so that harmony is re-created in society, with the main obligation of corporations as perpetrators of criminal acts is to restore the losses incurred.
With an integral law enforcement approach, it is hoped that it will create a stable life order, which is able to provide justice and legal certainty for corporations and society.
"At the same time being able to provide tangible benefits to advance the life of the nation and state," said the Attorney General.
