Waiting For Mardani Maming To Show Up At KPK After His Pretrial Was Rejected
JAKARTA - The panel of judges of the South Jakarta District Court (PN) rejected the pretrial submitted by the former Regent of Tanah Bumbu, South Kalimantan (Kalsel) Mardani H. Maming. Now, the Corruption Eradication Commission (KPK) is waiting for his commitment to cooperatively surrender himself.
Knocked on Wednesday, July 27 afternoon, Sole Judge Hendra Utama Sutardodo stated that the pretrial submitted by Mardani was rejected.
Mardani's application was named by the KPK as a suspect in the alleged bribery and gratification of a mining business permit in Tanah Bumbu Regency, South Kalimantan.
"Declaring the applicant's pretrial is unacceptable," said Sole Judge Hendra Utama Sutardodo at the South Jakarta District Court, Wednesday, July 27.
All of Mardani's requests in this pretrial were rejected. The reason is that the KPK has worked according to the applicable procedures in the process of determining the suspect.
Not only that, but the judge also considered that the pretrial proposed by Mardani touched the main area of corruption allegations. With this decision, the General Treasurer of the Nahdlatul Ulama Executive Board (PBNU) remains a suspect.
"Setting zero case fees," said Hendra.
This decision was later appreciated by the KPK. Acting KPK Spokesperson for Enforcement, Ali Fikri, said the judges were objective and independent.
The KPK, continued Ali, also believed from the beginning that he would win this pretrial lawsuit. The reason is that all the steps taken are in accordance with applicable laws.
"The judge has been objective and independent in deciding the application case," said Acting Spokesperson for the KPK for Enforcement, Ali Fikri, to reporters, Wednesday, July 27.
Furthermore, the KPK awaited Mardani's presence at his headquarters. Moreover, since the beginning, his attorney often said he was waiting for a pretrial decision.
As for the pretrial, Mardani collaborated with former Deputy Minister of Law and Human Rights (Wamenkumham) Denny Indrayana and former Deputy Chairman of the KPK Bambang Widjojanto.
"(KPK, ed) is waiting for the suspect's cooperative attitude as promised by his legal representative which was conveyed to the public that the suspect will be present at the KPK Red and White Building on July 28, 2022," said Ali.
Mardani needs to show a cooperative attitude so that the process of investigating the alleged corruption he carries out becomes clearer. "And let's test it together in a corruption court," said Ali.
Meanwhile, Denny Indrayana as Mardani's attorney did not want to talk much about his client's presence at the KPK's Red and White House on Thursday, July 28. In fact, from the start he asked for time until the pretrial decision was made.
"God willing (I'll come, ed)," said Denny to reporters at the South Jakarta District Court.
VOIR éGALEMENT:
Previously, Mardani was named a suspect after being prevented from going abroad by the Directorate General of Immigration at the request of the KPK. Before being named a suspect, he had also been questioned.
However, after being questioned, Mardani admitted that he was asked for information regarding his problem with the owner of PT Jhonlin Group Samsudin Andi Arsyad alias Haji Isam.
Even so, Maming was once said to have received IDR 89 billion in money in a trial for alleged bribery of a mining business license (IUP) in Tanah Bumbu Regency which was held at the Corruption Crime Court, Banjarmasin, South Kalimantan (Kalsel).
This allegation was conveyed by the younger brother of former President Director of PT Prolindo Cipta Nusantara (PCN) Henry Soetio, Christian Soetio. At that time, Christian claimed to know that there was a flow of funds to the former Regent of Tanah Bumbu Mardani H Maming through PT Permata Abadi Raya (PAR) and PT Trans Surya Perkasa (TSP).
The money transfer has been going on since 2014. The amount of tens of billions of rupiah is referred to as the amount quoted based on PT PCN's financial statements.
