Peradi Otto Hasibuan's Articles Of Association Canceled MA, Peradi DPN Calls Problem Solved
JAKARTA - The National Board of Trustees (DPN) of the Indonesian Advocates Association (Peradi) emphasized that the problems that led to the Supreme Court's (MA) cassation decision regarding changes to the articles of association and bylaws (AD/ART) were not valid, but had actually been completed.
The head of the Peradi Legal Aid Center (PBH) Suhendra Asido Hutabarat said the plaintiff, Alamsyah, had agreed to make peace with the Peradi DPN. Thus, the lawsuit should have been dismissed.
"So Mas Alam has made a statement that does acknowledge the National Conference and recognizes the leadership of Prof. Otto Hasibuan and his management," Asido told reporters, Thursday, April 21.
In the peace agreement, Alamsyah, who previously sued for changes to the provisions of the AD/ART without going through a plenary meeting, agreed to withdraw his lawsuit. Because, the change is considered as an improvement of management.
The peace agreement took place on April 5 or before the Supreme Court's cassation decision.
In fact, Asido said, in Alamsyah's lawsuit, there was not a single point related to Otto Hasibuan's leadership in Peradi.
"So this issue doesn't really exist anymore, because as a plaintiff, we have acknowledged the National Conference, acknowledged the management and leadership of Prof. Otto Hasibuan," he said.
In addition, Alamsyah said that with the peace agreement, he would ask the Supreme Court not to execute the decision that had been made.
"Regarding the Supreme Court's decision to reject (Peradi's cassation), then my next legal step against the decision, I will not request execution," said Alamsyah.
For information, the Supreme Court issued a cassation decision numbered 997 K/PDT/2022, dated April 18, 2022.
The decision was about rejecting the appeal filed by Peradi Otto Hasibuan on the decision of the Lubuk Pakam District Court.
Meanwhile, the Lubuk Pakam District Court decision stated that the Peradi DPN Decree No.KEP.104/PERADI/DPN/IX/2019 dated 4 September 2019 did not have permanent legal force.
Meanwhile, this problem led to the release of Hotman Paris from the Peradi organization. Because, Hotman considered that there was something wrong or had problems with Peradi, such as the illegitimate leadership of Otto Hasibuan's three terms, because they were deemed to have violated Peradi's Articles of Association / Bylaws (AD / ART).
