PNKN Says Something Is Hidden By The Government In The Formulation Of The IKN Law
JAKARTA - The Coordinator of the National Axis of State Sovereignty (PNKN) Marwan Batubara explained why his party proposed a formal test. Marwan said, the government and the DPR are considered to have conspired in the formulation of the IKN Law.
"There was an evil conspiracy between the government and the DPR. Why? Because they hide essential and strategic things from what should be the contents of the law," Marwan told reporters in front of the Constitutional Court (MK) Building on Jalan Medan Merdeka Barat, Gambir District, Central Jakarta, Wednesday 2 February.
"They hide it and they say it will be regulated in implementing regulations, whether it's a PP (Government Regulation or Perpres (Presidential Regulation)," added Marwan.
According to him, many essential and strategic matters that should involve community participation in the discussion process, are actually monopolized in implementing regulations.
He explained that Article 44 of the State Capital Law (IKN) stated 13 orders for delegation of regulatory authority in implementing regulations. This means that the IKN Law does not regulate in detail the IKN government administration and the IKN Law is still very macro in regulating matters concerning IKN.
"The various delegated materials in the 13 delegation orders in the IKN Law above should be the content material regulated at the level of the law, because they are strategic in nature," he said.
In fact, said Marwan, the people and the DPR should have the right to participate in determining the process of creating the strategic and important content of the IKN Law.
"Now we think that the government and the DPR have committed a very real crime, hiding essential, important, strategic things to be regulated in PP and Perpes, not regulated in the Act," he said.
Regarding the application for a formal examination of the IKN Law, Marwan admitted that this time the application was submitted by 12 figures. However, it is very likely that the name of the applicant will be added in the repair process.
"What we have conveyed is that there are only about 12 applicants, in order for us to speed up the process. But later in the repair, we believe that there will be more than 100 people," he said.
