Winning The Appeal, X Successfully Blocks The Content Moderation Act In California

JAKARTA X, Elon Musk's platform, has won a legal appeal over the implementation of California laws regarding content moderation transparation. This decision was issued on Wednesday, September 4.

The judge of the US Court of Appeal for the 9th Circuit received an appeal filed by Musk last year so that a decision from a lower judge was no longer in effect. Previously, lower courts ruled that California's content moderation laws could be applied to the company.

This decision was issued by US District Court Judge William Shubb. Quoted from Reuters, the judge stated that California's content moderation law, "can be justified and not too burdensome in the context of First Amendment law."

If this law is enacted, X should publish public reports regarding content moderation practices. Companies must explain all their actions and policies in overcoming disinformation, harassment, hate speech, and extremism.

This report must also include data from content moderation practices. X must notify the Californian public of the number of posts deemed inappropriate for other users to see and how the company handles the upload.

Last year, Musk sued a lower court ruling to the US Court of Appeals for the 9th Circuit. In his lawsuit, the billionaire said that the rules imposed by the law had violated the protection of free speech under the First Amendment to the US Constitution.

After winning the appeal they filed, neither X nor his lawyers have yet to provide an official response. Musk, also did not discuss this victory on his official social media because he was busy arguing with the Brazilian government.
