The Chinese Government Draft Laws Regulating Deepfake Technology And Its Derivatives

JAKARTA - China's cyber regulator issued a draft regulation on Friday, January 27 for content providers that alter facial and voice data. This is the latest move to crack down on "deepfakes" and establish a virtual space that promotes China's socialist values.

The rules are aimed at further regulating technologies such as those that use algorithms to generate and modify text, audio, images, and video, according to documents published on the China Cyberspace Administration's website.

Any platform or company that uses deep learning or virtual reality to transform any online content, what CAC calls a "deep synthesis service provider", is now expected to "respect morality and social ethics, adhere to the right political direction".

Regulations stipulate that people are protected from being disguised without their consent by deepfakes - images that are virtually indistinguishable from the original, and easy to use for manipulation or misinformation.

"Where a deep synthesis service provider provides significant editing functionality for biometric information such as human faces and voices, it will require (the provider) to notify and obtain individual consent of the subject whose personal information is being edited," reads Article 12 of the article. the concept of the rules

The rule stipulates a fine of between 10,000 and 100,000 yuan (Rp. 22 million to Rp. 226 million) for first-time violators but violations can also lead to civil and criminal prosecution.

The design also provides a user complaint system and mechanism to prevent deep falsification from being used to spread false information. App stores will be asked to suspend or remove fake technology providers if necessary.

“Deep synthesis services are also used by some criminals to produce, copy, publish and disseminate illegal information; slander and demean the reputation, the honor of people; and impersonating others to commit fraud and other illegal acts – not only to damage vital interests, but even endanger national security and social stability," the draft regulation said, as quoted by Reuters.

"It is urgent to draw the 'bottom line' and 'red line'."

Entities will undertake projects in areas such as manufacturing, energy, government services and taxes, law, education, health, trade, and finance, as well as cross-border finance.
