Knock! Aceh Syar'iyah Court Frees Defendant Of Raping Biological Child

ACEH - The Aceh Syar'iyah Court (MS) has acquitted the perpetrators of child rapists in Aceh Besar with the initials SUR (45), the defendant who is the biological father of the victim and also a member of the State Civil Apparatus (ASN).

"It is true that there is a decision No. 22/JN/2021/MS Aceh in which the verdict states that the defendant has not been proven legally and convincingly guilty of committing rape," said Public Relations of the Aceh Syar'iyah Court, Darmansyah Hasibuan, in Banda Aceh, reported by Antara, Friday, 8 October.

The acquittal was read out by the judge in the appeal hearing which took place at the Aceh Syar'iyah Court.

In his decision, the judge stated that the defendant SUR was not legally and convincingly proven guilty of committing rape against a person who had a mahram relationship as the first alternative indictment regulated in Article 49 Aceh Qanun Number 6 of 2014 concerning Jinayat Law. Whereas previously, at the trial at the first level the defendant SUR was found guilty by the Jantho Aceh Besar Syar'iyah Court with a sentence of 180 months in prison, and finally he appealed to MS Aceh.

The defendant was previously arrested by the Banda Aceh Police Satreskrim in February 2021, for allegedly sexually abusing his own four-year-old biological child.

SUR is a civil servant who served in one of the agencies in the city of Banda Aceh. The incident that happened to the poor boy was at the defendant's house in Aceh Besar.

The defendant was previously reported to the police by the victim's mother (the perpetrator's wife) who happened not to live at home anymore, and she was finally arrested at her home on Tuesday, February 16.
