Demanded By The Workers Union Regarding The Formation Of Sub-Holding, Pertamina: All Were Approved By The Shareholders

JAKARTA - PT Pertamina (Persero) was sued by its workers' union that is part of the Pertamina Union Federation of Workers Union (FSPPB). Not only that, this state-owned company, BUMN Minister Erick Thohir was one of the defendants. This lawsuit is related to the formation of five Pertamina sub-holding companies.

Responding to this, Pertamina's Vice President for Corporate Communication, Fajriyah Usman, said that Pertamina's restructuring was in accordance with shareholder decisions as stated in the White Book and the BUMN transformation road map.

"As a state-owned company, all Pertamina policies must refer to the shareholder's direction, in this case the BUMN Minister representing the Government," he said, in a written statement received by VOI, Wednesday, July 22.

Furthermore, Fajriyah explained, in carrying out this policy, Pertamina's management always considers strategic aspects, procedures, including all company assets and employees in accordance with applicable legal regulations.

Regarding workers, Fajriyah said, Pertamina maximizes the empowerment of workers by ensuring that the employment status of all Pertamina employees remains the same by protecting work relationships. As well as the normative rights of workers, such as the provisions of the company wherever they are assigned, both in the parent company (holding) and (sub-holding).

"Pertamina ensures that all Pertamina business processes run well, in order to ensure that services to the public continue to run. Management and employees also remain focused on working and innovating to face the challenges ahead and realizing proud innovations and achievement targets such as Fortune 100 and Green Energy," he said. .

In addition, Fajriyah ensured that the decision process was carried out prudently and professionally, in line with existing laws and regulations. In fact, with this step, the Government hopes that Pertamina can develop its business more aggressively so that it can increase the company's contribution to the Government.

"Pertamina is currently focusing on a successful restructuring in order to improve operational and financial performance," he said.

Causes of Trade Union Claims

Previously, in June, Erick Thohir had issued a decision on Dismissal, Change in Nomenclature of Position, Transfer of Tasks and Appointment of Pertamina's Directors. The decision was followed by a Decree from the President Director of Pertamina regarding the Basic Organizational Structure of Pertamina (Persero), which was marked by the formation of five Pertamina sub-holding companies.

The decision by Erick and Pertamina's board of directors provoked a reaction from workers and led to the filing of a lawsuit by the United Pertamina Workers Union Federation (FSPPB) against both of them.

Erick and the Pertamina directors are considered to have issued a unilateral decision that not only harmed workers, but also transferred state assets and finances managed by Pertamina.

FSPPB assesses, merger, consolidation, takeover and change of form of Limited Liability Company Legal Entities must pay attention to the interests of employees, who are represented by the Workers Union, as regulated by law and legislation.

The Lawsuit against the Law was filed at the Central Jakarta District Court via Online Registration (e-court), Monday July 20, 13.00 WIB.
