JAKARTA - The Jakarta State Administrative Court (PTUN) has granted all of Rusnawi Faisol's claims against the West Nusa Tenggara (NTB) National Population and Family Planning Agency (BKKBN).

Rusnawi sued the Decree (SK) of the NTB BKKBN. This is because the decree issued by the NTB BKKBN is not registered with the State Civil Service Agency (BKN).

However, the NTB BKKBN has not implemented the Jakarta Administrative Court decision. The BKKBN even took an appeal against the decision. Rusnawi also felt disappointed with the BKKBN's move.

"The BKKBN should not have appealed. So I became the representative (Head of the NTB BKKBN)," Rusnawi told VOI, Jakarta, Wednesday, September 29.

The following is the decision of the Jakarta Administrative Court

1. Granted the Plaintiff's Claim in its entirety;

2. Declaring the cancellation of the Decree of the Head of the National Population and Family Planning Agency Number: 95/KP.11.02/B2/2021, dated January 13, 2021 regarding the enforcement of the Decree of the Head of the National Population and Family Planning Agency Number 129/KP.05.01/PEG/2020 concerning Appointment in Primary High Leadership Position on behalf of dr. Rusnawi, F., Sp. KK.;

3. Require the Defendant to revoke the Decree of the Head of the National Population and Family Planning Agency Number: 95/KP.11.02/B2/2021, dated January 13, 2021 concerning the Enforcement of the Decree of the Head of the National Population and Family Planning Agency Number 129/KP.05.01/PEG/ 2020 concerning Appointment in Primary High Leadership Position on behalf of dr. Rusnawi, F., Sp. KK.;

4. Require the Defendant to rehabilitate the Plaintiff in the form of restoring the Plaintiff's rights in his capacity, position, dignity and status as before as the definitive Head of Representative of the National Population and Family Planning Agency of West Nusa Tenggara Province;

5. Sentencing the Defendant to pay the costs incurred in this case in the amount of Rp.337,000.00 (three hundred and thirty-seven thousand rupiah);

Rusnawi's journey to become the Head of the NTB BKKBN

Rusnawi (53), is willing to retire early from the position of Colonel in the Air Force after being declared to have passed the open selection of the National Population and Family Planning Agency (BKKBN).

Rusnawi passed all the processes and was inaugurated as the Head of the West Nusa Tenggara (NTB) BKKBN on April 1, 2020. Then, oddities began to appear when the Decree (SK) as the Chair of the NTB BKKBN Representative was to be printed.

Where, said Rusnawi, the BKKBN HR arbitrarily entered his NIP using his membership number when he was still a TNI soldier.

"So the NIP is just added to my NRP. Plus 0, the end is added 12. The reason is just inputting the SK so that the SK can exit the computer system. So that's the NIP. already retired," said Rusnawi.

In addition to accessing SK, NIP is also used in the KPPN system to receive salaries and all their rights. At first, it was all fine.

However, when he decided to retire early from his position, his KPPN account could not be accessed so he could not receive a salary.

"There was a problem in September, because my account from the NRP was closed while the NIP was not registered or not original," said Rusnawi.

Finding this problem, the NTB BKKBN then tried to send a letter to the center which was then forwarded to the BKN to request a change of status from the TNI to the BKKBN ASN. However, the reply letter from BKN actually refused with complicated reasons.

"In November, the letter was replied to, rejected by BKN with complicated reasons. It was twisted. The basis for me to pass the open bidding was clear that PP 11 of 2017 from Article 147 to Article 159. His reasoning has been revised by the PP, even though it is impossible to apply because we are still the old one is the time of selection," he said.
