Evidence Of Methamphetamine Is Less Than 1 Gram, Coki Pardede Can Be Rehabilitated

JAKARTA - Stand-Up Comic Reza Pardede alias Coki Pardede has been named a suspect in a case of using methamphetamine. The evidence of methamphetamine found weighing 0.5 grams.

However, instead of being detained, the Institute for Criminal Justice Reform (ICJR) said that Coki Pardede could be sought for rehabilitation. Because Coki has less than 1 gram of methamphetamine.

"Referring to the regulation on possession of methamphetamine-type narcotics under 1 gram based on SEMA 4/2010 in conjunction with SEMA 3/2011, Coki can be classified as a narcotics user and rehabilitation must be sought," said ICJR Executive Director Erasmus Napitupulu in a statement, Sunday, September 5.

This rehabilitation effort is also in line with the Guidelines for Prosecuting Prosecutors' Guidelines Number 11/2021 concerning the Handling of Narcotics Crime Cases and/or Narcotics Precursor Crimes, which stipulates that narcotics users who are subject to Article 127 of the Narcotics Law must be immediately rehabilitated.

Erasmus said law enforcement must be able to confront the integrated assessment team (TAT) to ascertain Coki's position as a drug user. "The results of this TAT will form a strong basis for Coki's rehabilitation," said Erasmus.

According to Erasmus, the condition of the evidence is still below the threshold limit by existing regulations, so Coki as a user who should be protected should not be humiliated or punished.

"This action will only give a bad stigma and make access to health for drug users will be further," he said.

Erasmus views that the Narcotics Law has again failed and is not a solution to the problem of illicit narcotics trafficking in Indonesia.

"The Narcotics Law only opens up great opportunities targeting narcotics users who should be protected not punished, and in the end is the criminalization of narcotics users," said Erasmus.

"So, ICJR again calls for changes to the Narcotics Law to ensure that narcotics users avoid imprisonment, the Health approach must replace the criminal approach which has been proven to fail," he continued.

Separately, the Head of Public Relations of the Polda Metro Jaya Kombes Yusri Yunus responded to Coki's opportunity to be rehabilitated. Yusri also invited Coki to propose rehabilitation efforts.

"We are still in the process. The rules for the mechanism will be available later. Go ahead, that's his right (to apply for rehabilitation). That's what (determines) rehabilitation or not, based on the BNN (National Narcotics Agency) assessment," said Yusri.

For information, the Tangerang City Metro Police yesterday named Coki Pardede as a suspect in the use of methamphetamine after his arrest on Thursday, September 2. Besides Coki, two other people were also named as suspects.

Among them are WL who acts as a courier for delivering methamphetamine to Coki and RA as a drug dealer or supplier.

All three are subject to Article l 114 paragraph (1) Subs Article 112 paragraph (1) in conjunction with Article 132 of the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics for a minimum of 6 years and a maximum of 20 years.
