JAKARTA - The Corruption Eradication Commission (KPK) has appealed the two-year sentence against the inactive Mayor of Cimahi Ajay Muhammad Priyatna because the sense of justice has not been fulfilled. The submission was made to the Bandung High Court.
"After we studied the considerations of the panel of judges, the KPK Prosecutor's Team has declared an appeal to the Bandung High Court," Acting KPK Spokesperson for Enforcement Ali Fikri told reporters, Wednesday, September 1.
The KPK argued that the appeal was filed for a number of reasons, namely that the decision against Ajay was considered unfair. "Especially in the matter of imposing criminal orders, both imprisonment and additional penalties in the form of the amount of money charged as compensation for the proceeds of corruption enjoyed by the defendant and the revocation of the right to be elected in public office," said Ali.
Next, an appeal was filed because the prosecutor's indictment was not proven regarding proof of Article 12 letter a of the Anti-Corruption Law related to bribery and gratification.
"We are of the opinion that the Panel of Judges in their consideration has ignored the legal facts revealed at the trial," said Ali.
Actually there are other reasons behind the appeal to the Bandung High Court. However, Ali said, everything will be written in full in the appeal memorandum of the KPK Public Prosecutor (JPU) which will soon be drawn up.
"We will immediately draw up a memorandum of appeal and submit it to the High Court through the Bandung District Court clerk," he said. Previously, the inactive Mayor of Cimahi, West Java, Ajay M Priyatna, was sentenced to two years in prison for a bribery corruption case to smooth out licensing for a hospital project.
The verdict was lighter than the demands made by the KPK Public Prosecutor (JPU), namely a 7-year prison sentence.
"The defendant Ajay Muhammad Priatna was sentenced to two years in prison and a fine of Rp. 100 million, subsidiary to 3 months in prison," said Chief Justice Sulistyono at the Bandung District Court, Bandung City, as reported by Antara, Wednesday, August 25.
In the decision, Ajay was found guilty according to Article 12 letter a. In addition, the judge was of the view that one thing that weighed on Ajay was not supporting the government's efforts to eradicate corruption.
Meanwhile, the mitigating factor, according to the Panel of Judges, the defendant was polite during the trial process and had family responsibilities.
