KPK Will Study Komnas HAM Findings Regarding Human Rights Violations In The TWK Process For Its Employees

JAKARTA - The Corruption Eradication Commission (KPK) acknowledged that it respects and will study the findings of the National Human Rights Commission (Komnas HAM) on violations in the implementation of the National Insight Test Assessment (TWK) for its employees.

However, this will only be done after it receives the findings from Komnas HAM which were read out this afternoon or Monday, August 16.

"So far, the KPK has not received the results. As soon as we receive them, we will of course study in more detail the findings, suggestions, and recommendations from Komnas HAM to the KPK," Acting KPK Spokesperson for Enforcement Affairs Ali Fikri told reporters, Monday, August 16.

Even so, he emphasized that the process of changing the status of KPK employees to State Civil Apparatus (ASN) was not carried out arbitrarily without any basis. According to Ali, the status transition is in accordance with the mandate of applicable laws and regulations, such as Law Number 19 of 2019, Government Regulation Number 41 of 2020, and Perkom Number 1 of 2021.

In the implementation of the TWK, Ali also ensured that his institution complied with the applicable rules. "Including the decision of the Constitutional Court and the president's mandate, which involves ministries/state institutions that have the authority and competence in the process," he said.

Ali asked all parties to wait for the results of the examination at the MA and MK levels. He said that the lawsuits in the two institutions were carried out to test whether the legal basis and implementation of this status transfer were appropriate or not.

"As a country that upholds the principle of law, we should also wait for the results of the examination. To test whether the legal basis and implementation of this status transfer have been appropriate or not," he said.

Previously reported, Komnas HAM found that 11 human rights were violated in the implementation of the TWK of KPK employees. The eleven rights that have been violated are the right to justice and legal certainty; women's rights; the right not to discriminate; the right to freedom of religion and belief; right to work; and the right to security.

The next right that is violated is the right to information; right to privacy; the right to freedom of assembly and association; the right to participate in government; and the right to freedom of expression.

As a result of this violation, five recommendations were submitted to President Joko Widodo (Jokowi) as the highest authority holder and the highest staffing officer. Among them are restoring and appointing KPK employees who were declared not to have passed the TWK as ASN and restoring the good name of employees who were stigmatized as a result of this incident.
