JAKARTA - President Joko Widodo (Jokowi) 's decision to increase BPJS Health contributions in the midst of the coronavirus or COVID-19 pandemic has drawn public criticism. The government is considered absent and turns a blind eye to the difficulties faced by the community. However, this was denied by the BPJS Kesehatan boss.

President Director of BPJS Kesehatan, Fachmi Idris emphasized that the government's decision to increase participant fees through Perpres 64/2020 is still in the corridor of a Supreme Court (MA) decision regarding the cancellation of the increase in contributions.

Fachmi explained, in the Supreme Court ruling Number 7 / P / HUM / 2020 there were three options for the government to follow up, namely revoking, changing, or implementing it. The government's decision in this matter is to change. So, this also answers the issue of Jokowi outsmarting the Supreme Court decision.

"If we look, it means that Pak Jokowi is still in the corridor, namely in the context of changing. I want to clear that it is not true that the government does not respect (the Supreme Court decision)," he said, in a video conference with journalists on the theme 'National Health Insurance', Thursday, 13 May.

Fachmi assessed that it is not true that Perpres 64/2020 does not side with the community. According to him, in this Perpres the role of the state is enhanced.

Furthermore, Fachmi said, through Presidential Decree 64/2020, the government is helping the community in the midst of the COVID-19 pandemic. One of them, by providing assistance to participants who do not receive wages (PBPU) and non-workers (BP) class III independently.

As is known, in Perpres 64/2020 article 34, class III participants will receive a subsidy of IDR 16,500 per person per month in 2020, and IDR 7,000 per person per month in 2021.

This means that the premiums paid by BPJS Kesehatan class III independent participants are IDR 25,000 in 2020 and IDR 35,000 in 2021. According to Fachmi, if the government does not subsidize, the amount of contributions that should be paid by class III participants is IDR 42,000 per person per month. .

"The issuance of Perpres 64/2020 is considered to be impartial to the people. The presence of this Presidential Regulation in fact returns fundamental values in national health insurance. The government is present, the state is present, very committed, so if there is an issue of this Presidential Regulation the state is not present, it is not true. the presence of the state is bigger than before, "he said.

Previously, the member of the National Social Security Council (DJSN) who took care of legality, Indra Budi Sumantoro, said that the Presidential Decree 64/2020 concerning the Second Amendment to Perpres 82/2018 concerning Health Insurance was in accordance with the law.

Indra explained that the decision to increase this fee was in accordance with the Social Security Administration Act (BPJS Law) and the National Social Security System Law (SJSN Law). So, the government can make contributions and benefits in the midst of the BPJS Health financial crisis.

Furthermore, Indra said, in Article 65 paragraph 3 of the BPJS Law it was stated, in terms of financial crises and certain conditions that were burdensome to the economy. The government can take special measures to maintain financial health and the sustainability of social security programs.

"This takes into account the SJSN principles, namely humanity, justice and benefits. In the SJSN Law in article 2, it is intended that to ensure the sustainability of the program and the rights of the participants.
