JAKARTA - Deputy Chairman of the Corruption Eradication Commission (KPK) Nurul Ghufron considers the summons made by Komnas HAM related to the National Insight Test (TWK) assessment is unclear.
This is why they did not come when called on Tuesday, June 8 and chose to send a letter.
"KPK conveyed the reason that we need certainty that what we will question us about is related to the alleged human rights violations," said Ghufron to reporters in Jakarta, Friday, June 11.
According to him, this is important because the leaders of the anti-corruption commission need certainty about what violations have been committed in the test process as a condition for the transfer of their employee status.
Ghufron also said that this certainty was important so that they could prepare the necessary documents.
Moreover, this legal certainty has been regulated in Law Number 30 of 1999 where Article 3 states that everyone has the right to legal protection and legal certainty.
"Well, one of the legal certainty is the certainty of what the invitation is for," he said.
Ghufron then compared the summons made by Komnas HAM with the KPK. According to him, his subordinates are always clear when they will call someone for questioning in a corruption case.
"KPK always invites, asking for witness statements is always clear. For example, the X is asked for his statement in what article corruption allegations," he said.
"Because it wasn't clear, we didn't give it (a statement, ed) then we asked. In fact, it's clear from the reporter. They complained to the KPK leadership about what human rights violations were alleged to have done? .
Furthermore, he also rejected the KPK leadership being said to be absent from the summons. Considering that there was already a letter sent on Monday, June 7 or the day before the scheduled summons.
"KPK is not absent. The so-called defaulters were not present and did not give reasons," he said.
As previously reported, Komnas HAM did summon the KPK leadership on Tuesday, June 8 so that they could clarify allegations of human rights violations in the TWK process. This allegation was reported by representatives of 75 employees of the anti-corruption commission who were declared ineligible and thus disabled from their jobs.
Commissioner for Monitoring and Investigation of Komnas HAM, Choirul Anam, said that this summons needed to be made so that his party could hear statements from the two parties involved in the complaint. Thus, the results or findings of Komnas HAM will be balanced.
For information, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.
Meanwhile, 75 employees, including Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of PJKAKI Sujarnarko were declared ineligible (TMS). While the other two employees did not attend the interview test.
According to the employees who were declared unsuccessful, there were a number of anomalies in the implementation of this assessment. Including, there are a number of questions that are considered to violate the private sphere.
