JAKARTA - The land dispute in the Bintaro area has resurfaced in the public. The lawyer for Sajuti Munih's heirs, Erdi Surbakti, revealed a number of irregularities in the issuance of land administration documents that allegedly involved land mafia practices.

One of the points highlighted was the alleged administrative error in the 2019 Sale and Purchase Deed (AJB) regarding the inclusion of the land object area.

Erdi explained that his client had a legal basis in the form of Girik C Number 1804 Persil 140 D II on behalf of the taxpayer Sajuti Munih which was recorded at the Bintaro Village Office, Pesanggrahan District, South Jakarta. According to him, the heirs have occupied the land object for generations and have never made a sale transaction.

However, disputes began to emerge in 2009 when two Certificates of Ownership (SHM), namely SHM Number 1 and SHM Number 3200 in the name of the late Vincentius Sardjito, were issued on the same land object.

"South Jakarta Police had handled reports related to this issue. Based on the results of the Puslabfor Mabes Polri Test Number 44/DTF/2010, document AJB Number 0126/AGR/1968 dated September 19, 1968 was declared non-identical or suspected to be false," said Erdi in his statement, Saturday, May 23.

According to Erdi, the anomaly was strengthened by the answer letter from the Ciputat Sub-district Head dated December 9, 2021 which stated that there was no AJB file that served as the basis for the issuance of the SHM.

The legal representative also found a difference in the girik used as the basis for the issuance of the certificate. According to him, the girik used is not derived from the physical object of the disputed land, but uses Girik C 1804 Persil 14 A.

Erdi also highlighted the attitude of the South Jakarta Land Office, which was considered to have not provided adequate clarification regarding the land deed since the report was submitted to the Polda Metro Jaya through LP/3966/X/2014/PMJ/DITRESKRIMUM in October 2014.

The issue then developed in 2019 when the SHM in question was used as the basis for a transaction to buy and sell to the Triguna Foundation. Erdi suspected that there were false statements in the AJB.

"In Article 2 of the AJB it is stated that the object being traded is free from disputes. In fact, since 2014, legal proceedings for alleged forgery are underway at the Polda Metro Jaya," he explained.

He also highlighted administrative errors in the inclusion of land object areas in the 2019 AJB.

"In the AJB 2019, the location of the land is written in the Kebayoran Lama District, Bintaro Village. In fact, administratively, the state in 2019 does not have a Bintaro Village under the Kebayoran Lama District. The correct one is Bintaro Village, Pesanggrahan District," he said.

Based on the document, a Building Use Rights Certificate (SHGB) Number 2114 and 2115 was issued in the name of the Triguna Foundation which was said to have been issued through the notary Novita Ramanadireksa.

The heirs admitted that they had asked the Directorate General of Disputes of the Ministry of ATR/BPN to evaluate or cancel the SHGB. According to Erdi, the Director of Disputes at that time, Brigadier General Widodo, had even written to BPN South Jakarta, but until now there has been no concrete follow-up.

"We urge the Minister of ATR/BPN to immediately revoke SHGB Number 2114 and 2115 for the sake of the heirs' justice," he said.

The situation became more complex after in 2025 the Triguna Foundation allegedly transferred the management of the land to the educational institution Labschool for the construction of educational facilities.

Erdi asked the DKI Jakarta Education Office to evaluate the school's operational permit at the location because he was afraid that the land dispute could have an impact on teaching and learning activities.

"We regret the use of disputed land for educational facilities, because this risks harming students if there is legal action at the location," he said.

As the basis for the ownership claim, the heirs said they had an official letter from Bintaro Village in 2016 stating that Girik 1804 Persil 140 D II was still recorded and registered in the name of Sajuti Munih's heirs.

On this basis, the lawyer again reported the alleged falsification of the 2019 AJB and the SHGB of the Triguna Foundation to the Polda Metro Jaya through the STTLP/B/4661/VIII/2024/SPKT/POLDA METRO JAYA report dated August 10, 2024.

The heirs hope that law enforcement and the Ministry of ATR/BPN can resolve the dispute transparently and provide legal certainty for all parties.
