Leaders Meeting, KPK Chair Firli Et Al Did Not Comply With Komnas HAM's Summons

JAKARTA - Chairman of the National Human Rights Commission (Komnas HAM) Ahmad Taufan Damanik agrees that his party received news that the KPK leadership was not present at the examination scheduled for today or Tuesday, June 8. The reason is that they are currently holding a leadership meeting or rapim.

This summons relates to reports of alleged human rights violations in the implementation of the National Insight Test Assessment (TWK) which is a condition for the transfer of the status of KPK employees from independent to State Civil Apparatus (ASN).

"The news is that he couldn't come today because of the rapim," Taufan told reporters at the Komnas HAM office, Jalan Latuharhary, Central Jakarta, Tuesday, June 8.

Meanwhile, the letter which is said to have been sent by the head of the anti-corruption commission on Monday, June 7, has indeed been received. However, Taufan said he did not know about its contents because the letter had just been received by his subordinates.

Furthermore, when asked about the recall, he said it was possible to do this. This is because Komnas HAM needs clarification on what the KPK employees have previously questioned.

"We will ask, ask for clarification what was conveyed by the employees who have come here. There are dozens of people," said Taufan.

In addition, the KPK leadership will also be asked about the policies that underlie the implementation of the TWK so that it is known how standards, norms, principles, and any human rights have been violated. "The task of Komnas HAM is right there. To ensure every policy of state institutions, even the president," he said.

"Actually that's all, we want to make sure this policy is in accordance with human rights standards or not. If we say there are violations, of course we will give recommendations for improvements to the president, to the KPK itself. So things are actually normative," added Taufan.

As previously reported, the KPK stated that its leadership would not attend the summons of Komnas HAM and only sent a letter asking for an explanation of what human rights were violated in the process of transferring the status of its employees.

"Monday, June 7, 2021, the KPK leadership has sent a letter to Komnas HAM asking for an explanation of what human rights were violated in the implementation of the transfer of the status of KPK employees," Acting KPK Spokesperson for Enforcement Affairs Ali Fikri told reporters.

Furthermore, Ali emphasized that the transfer of employment status carried out by the KPK was a law mandate. The implementation of the TWK which is a requirement is also in accordance with the mechanisms and applicable laws and regulations.

"The implementation of TWK is carried out by BKN in collaboration with other relevant institutions through a process that is in accordance with the mechanism as stipulated in the applicable laws and regulations," he said.

For information, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.

Meanwhile, 75 employees, including Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of PJKAKI Sujarnarko were declared ineligible (TMS). While the other two employees did not attend the interview test.

According to the employees who were declared unsuccessful, there were a number of anomalies in the implementation of this assessment. Including, there are a number of questions that are considered to violate the private sphere.

These employees who did not pass, then reported the implementation of the TWK to Komnas HAM. Subsequently, a special team was formed, led by two commissioners, namely Choirul Anam and Sandrayati Moniaga to investigate the alleged human rights violations in this test.

In addition to submitting reports to Komnas HAM, these employees also report their leadership to a number of parties, from the KPK Supervisory Board to the Indonesian Ombudsman.
