Sanctions For Domino YouTuber Ferdian Paleka, Whose Whereabouts Are Unknown

JAKARTA - YouTuber Ferdian Paleka seemed to have disappeared without a trace after the video content of his fake aid distribution was brought to the realm of crime. This actually opened up the opportunity for the police to apply layered articles against Ferdian.

Criminologist at the University of Indonesia, Ferdinand Andi Lolo, said that article 224 paragraph 1 of the Criminal Code regarding not obeying officers could be another sanction that Ferdian would accept. However, this can only be applied if the investigator states that the reported party is not cooperative in the process of investigation.

Uncooperative means never coming or being present on the examination agenda. Even though the person concerned already knows about the examination agenda.

"If he is called to be asked for information by the police regarding the alleged criminal act of insulting the complainant and he deliberately does not come even though he knows it, the police can use Article 224 paragraph 1 of the Criminal Code with a threat of 9 months," said Ferdinand to VOI, Tuesday, May 5.

This is because the police can apply Article 221 paragraph 1 point 1 of the Criminal Code, which states that anyone who knows the crime committed by the perpetrator, but does not inform the police or hide the perpetrator can be subject to criminal charges.

"People who know the crimes committed by the perpetrators but do not tell the police or hide the perpetrators can face up to 9 months as well," said Ferdinand.

Kasat Reskrim Polrestabes Bandung AKBP Galih Indragiri said that temporarily Article 45 paragraph 3 of the Law on Information and Electronic Transactions (ITE) will be applied in this case. However, investigators must delve into all things from the video to ensure there are other criminal offenses from each individual.

"We will examine everything in the video. We still uphold the principle of the presumption of innocence. For the application of the article, we will see what each individual looks like," said Galih.

Meanwhile, regarding the progress of the case, said Galih, a reported person named Tubagus Fahddinar had surrendered himself, on Monday, May 4. So, only two other people are still at large.

For the reported Ferdian Paleka, his whereabouts are still unknown. Because, when the officers searched his residence, the young man was not found.

"We are still trying to secure other perpetrators. We suggest cooperating and surrendering," said Galih.

For your information, the case started when a video showing a group of youths providing assistance to others became a hot topic of discussion on social media. Now, the video has been deleted by Ferdian.

Criticism arose because the contents of the aid were not basic necessities or other daily necessities but some stones and rubbish.

This despicable action was uploaded to Ferdian Paleka's Youtube account. On the pretext of being a youth prank content named Ferdian as the main figure planning the action.

By preparing five boxes of instant noodles which were previously filled with stones and trash, this young man and several colleagues headed to an area. Their target is the transsexuals who are on the side of the road.

Based on the video recording, about 4 waria were successfully tricked with fake assistance. However, when they tried to target children, their actions failed because they had already been discovered.

Their actions were considered a very bad thing to do. Not long after, one of the victims finally decided to report this to the police.
