Lokataru Activist Pretrial Session, Polda Metro Jaya Asks Judges To Reject Lawsuit

JAKARTA - The Polda Metro Jaya legal team asked the judge to reject all pretrial applications submitted by the activist and Executive Director of the Lokataru Foundation, Delpedro Marhaen, regarding his determination as a suspect in the alleged incitement case in a demonstration that ended in chaos in August 2025.

"That the Respondent stated firmly that His Excellency, the sole pretrial judge, rejected the Petitioner's pretrial application in its entirety," said member of the Polda Metro Jaya legal team, AKBP Iverson Manossoh during a hearing at the South Jakarta District Court, Antara, Monday, October 20.

Iverson explained that the determination of the suspect against Delpedro had met the legal requirements with at least two valid pieces of evidence and through the case title mechanism.

"The determination of the suspect against the Petitioner based on the stipulation letter number STap/S-4/1539/VIII/2025/Ditreskrimum Polda Metro Jaya dated August 30, 2025 is legal according to law and has binding legal force," he said.

He emphasized that the steps taken by investigators were part of the task of the police in maintaining security and public order, in accordance with applicable legal provisions.

"Police officials have discretion to act according to their own assessment for the sake of the public interest as stipulated in Article 18 paragraph (1) of Law Number 2 of 2002 concerning the Indonesian National Police," said Iverson.

He added that the discretion was used in handling the Delpedro case because there were concerns about the disappearance of evidence.

In addition, according to Iverson, examining a person as a potential suspect before determining the suspect is not absolute, given that there is a legal basis that allows quick action to prevent greater risks.

"Based on Fixed Procedure Number 1 of 2010 concerning the Management of Anarchy Actions, the police are allowed to use discretion to defend themselves, protect the public from threats, and prevent criminals from escaping," he said.

The pretrial hearing of Delpedro Marhaen is registered with case number 132 / Pid.Pra / 2025 / PN JKT.SEL, with the Respondent, namely the Director of Cyber Investigation and the Director of General Criminal Investigation of the Polda Metro Jaya.
