Former Head Of Jakarta Education And Culture Sueded 12 Years In Prison In Fictitious SPJ Case

JAKARTA - Head of the DKI Jakarta Culture Service (Kadisbud) in 2020-2024 Iwan Henry Wardhana was sentenced to 12 years in prison in connection with a suspected corruption case in the form of making a fictitious letter of responsibility (SPJ).

The public prosecutor (JPU) from the Attorney General's Office (AGO) Arif Darmawan believes Iwan, together with the Head of the Utilization Division of the Jakarta Culture Service in 2024 Mohamad Fairza Maulana and the owner of the event organizer (EO) of the Production Outlet (GR PRO) Gatot Arif Rahmadi, were legally and convincingly proven guilty of committing a criminal act of corruption together.

"As threatened with crime in Article 2 paragraph (1) in conjunction with Article 18 paragraph (1) letter b of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code jo. Article 64 paragraph (1) of the Criminal Code, "said the prosecutor in the trial of reading the indictment at the Corruption Court at the Central Jakarta District Court, Thursday, confiscated by Antara.

In addition to imprisonment, the Public Prosecutor demanded that Iwan be sentenced to a fine of Rp. 500 million, provided that if the fine was not paid, it would be replaced (subsider) with imprisonment for 6 months.

Iwan is also required to be subject to additional penalties to pay compensation of Rp. 20.5 billion, subsidiary to imprisonment for 6 years, taking into account the assets of the defendant that have been confiscated in the investigation, as is the payment of replacement money in the form of buildings and land.

In the same trial, there were also Fairza and Gatot who listened to the reading of the indictment. Fairza was sentenced to 7 years in prison; a fine of Rp. 500 million, subsidiary to 6 months; and a replacement money of Rp. 1.44 billion, subsidiary to 3 years and 6 months, taking into account the confiscation of money in the investigation worth Rp. 1.01 billion and Rp. 50 million.

Meanwhile, Gatot was sentenced to 9 years in prison; a fine of Rp. 500 million, subsidiary to 6 months; as well as replacement money of Rp. 13.26 billion, subsidiary to 4 years and 6 months, taking into account assets that had been confiscated Rp. 7 million, one Suzuki car, and one unit of Nissan Evalia's car.

For their actions, Iwan, Fairza, and Gatot are believed to have violated Article 2 paragraph (1) in conjunction with Article 18 paragraph (1) letter b of Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code jo. Article 64 paragraph (1) of the Criminal Code.

In this case, the three were charged with harming state finances amounting to Rp36.32 billion. Iwan was charged with directing that all Community Cultural Arts (PSBB) events be handed over to Gatot.

This was done with an agreement that Gatot would contribute money in the form of money to be handed over to Iwan.

During the 2022-2024 period, Gatot, on the basis of the appointment of Iwan and Fairza's directives, has managed around 101 Community PSBB events, 746 PKT, and three Jakarnaval, with the realization of payments after tax cuts of Rp. 38.66 billion.

However, the actual amount of expenditure was only Rp. 8.19 billion, while the remaining more payments were misused amounted to Rp. 30.46 billion.

The difference in illegal payments was allegedly used to contribute money to Iwan, Fairza, Gatot, and other parties. Meanwhile, Iwan is said to have enjoyed illegal money amounting to Rp. 16.2 billion; Fairza Rp. 1.44 billion; and Gatot Rp. 13.52 billion.

Thus, the three defendants are suspected of violating Article 2 paragraph (1) or Article 3 jo. Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code jo. Article 64 paragraph (1) of the Criminal Code.
