The House Of Representatives Will Review The Constitutional Court's Decision On The Tapera Law

JAKARTA - Deputy Speaker of the House of Representatives, Sufmi Dasco Ahmad, responded to the decision of the Constitutional Court (MK) which granted the judicial review of case number 96/PUU-XXII/2024 regarding Law Number 4 of 2016 concerning Public Housing Savings (UU Tapera). Thus, workers are not required to be participants.

Dasco said his party was also monitoring the decision. According to him, the DPR will review the decision to be followed up by the relevant commission.

"Yes, we also monitor several decisions of the Constitutional Court which have just been decided, including Tapera," said Dasco at the DPR building, Senayan, Jakarta, Tuesday, September 30.

"We have asked the DPR's Expert Board to make a study which will later be coordinated with the DPR Baleg and related technical commissions to address what must then be done against the Constitutional Court's decision," continued the Gerindra legislator.

It is known that the Constitutional Court (MK) granted the judicial review of case number 96/PUU-XXII/2024 regarding Law Number 4 of 2016 concerning Public Housing Savings (UU Tapera) in a trial held on Monday, September 29.

"Granted the petitioner's application in its entirety," said Chief Justice of the Constitutional Court Suhartoyo.

In its legal considerations, the Constitutional Court stated that the term savings in the Tapera program caused problems for affected parties, especially workers.

This is because they are followed by the element of coercion by placing the word mandatory as Tapera participants, so conceptually, it does not match the characteristics of the true nature of savings because there is no longer free will.

Therefore, the Constitutional Court assessed that Tapera had shifted the meaning of the concept of savings which was actually voluntary to become coercive levies as argued by the Petitioner.
