Entering Humanitarian Crimes, Settlement Of Cases Of Death Of Affan Kurniawan Should Be In The Human Rights Court

JAKARTA Criminal law expert at Airlangga University, I Wayan Titib Sulaksana, said that the handling of the case of Affan Kurniawan's death should have been handled by the National Human Rights Commission (Komnas HAM), not by the Police.

"Because the victims who were killed were civilians, while the perpetrators were state officials (police). The only one authorized to carry out the investigation was Komnas HAM, not the police institution," he said, Friday, September 5, 2025.

According to him, the case of Affan Kurniawan's death was not in the realm of general crimes, but was a crime against humanity (crime against humanity). Therefore, after being investigated by Komnas HAM, the case must be escalated to an investigation by the Attorney General's Office, and tried in the Human Rights Court.

"The results of the Komnas HAM investigation have been increased to an investigation by the Indonesian Attorney General's Office. Then it was tried at the Human Rights Court," Titib said.

Seperti diketahui, Sidang Komisi Kode Etik Polri (KKEP) Komandan Batalyon (Danyon) Resimen IV Korps Brimob (Korbrimob) Polri, Kompol Cosmas K Gae, telah dilakukan.

Kompol Kosmas dipecat dari Polri buntut kasus tewasnya Affan Kurniawan, akibat dilindas kendaraan taktis (rantis) Brimob.

“Menjatuhkan sanksi berupa etika yaitu perilaku terlanggar dinyatakan sebagai perbuatan tercela dan sanksi Pemberhentian tidak dengan hormat atau PTDH sebagai anggota Polri,” kata Ketua Komisi Sidang Etik di Gedung TNCC Mabes Polri, Jakarta Selatan, Rabu 3 September.

Sedangkan dalam sidang Komisi Kode Etik Polri (KKEP) Kamis, 4 September kemarin, Bripka Rohmat pengemudi rantis yang melindas Affan Kurniawan diberi sanksi demosi atau penurunan jabatan sebagai anggota Polri selama tujuh tahun dan sanksi penempatan khusus (patsus) selama 20 hari.

Kompol Kosmas was fired from the National Police following the death of Affan Kurniawan, as a result of being run over by a Brimob tactical vehicle.

"Imposing sanctions in the form of ethics, namely violating behavior is declared a disgraceful act and sanctions for dishonorable dismissal or PTDH as a member of the National Police," said the Head of the Ethics Session Commission at the TNCC Building at the National Police Headquarters, South Jakarta, Wednesday, September 3.

Meanwhile, in the Police Code of Ethics Commission (KKEP) session last Thursday, September 4, Bripka Rohmat, a random driver who ran over Affan Kurniawan, was given a demotion or demotion as a member of the National Police for seven years and a special placement sanction (patsus) for 20 days.
