JAKARTA Criminal law expert at Airlangga University, I Wayan Titib Sulaksana, said that the handling of the case of Affan Kurniawan's death should have been handled by the National Human Rights Commission (Komnas HAM), not by the Police.
"Because the victims who were killed were civilians, while the perpetrators were state officials (police). The only one authorized to carry out the investigation was Komnas HAM, not the police institution," he said, Friday, September 5, 2025.
According to him, the case of Affan Kurniawan's death was not in the realm of general crimes, but was a crime against humanity (crime against humanity). Therefore, after being investigated by Komnas HAM, the case must be escalated to an investigation by the Attorney General's Office, and tried in the Human Rights Court.
