20 Companies In Surabaya Reported THR Violations

JAKARTA - A total of 20 companies in a number of districts and cities in East Java were reported to the Legal Aid Institute (LBH) Surabaya related to alleged violations of the payment of holiday allowances (THR) 2021 to workers.

THR LBH Surabaya complaint post coordinator Habibus Shalihin said the 20 companies had 3,452 workers.

"The findings of the alleged violations are religious holiday allowances are not paid, THR is not paid in accordance with the provisions, THR is paid late, THR is paid by installments and also THR is replaced with gifts," he said.

He said, YLBHI-LBH Surabaya together with DPW-FSPMI East Java and (KRPI) East Java mentioned the legal basis of the violation is a circular of the Minister of Manpower number M/6/Hk.04/IV/2021 concerning the implementation of the provision of Day Allowance Religious Festival in 2021 for Workers / Workers in the Company and Government Regulation No. 36 of 2021 on Wages and Regulation of the Minister of Manpower of the Republic of Indonesia No. 6 of 2016 concerning Religious Holiday Allowance for Workers or Workers in the Company.

"In the findings of violations complained by the average complainant is a company spread in several cities or districts in East Java namely Surabaya, Gresik, Sidoarjo, and Banyuwangi," he said.

He said that for the status of workers who reported as much as 53 percent of permanent employees, 26 percent of contract employees, 14 percent of outsourcing employees and the remaining 7 percent were freelance daily workers.

Based on the findings, he said, Post THR East Java at least has provided recommendations to the East Java Employment Office to be cracked down on 20 companies in East Java.

"Because of the violations that are widely complained in the complaint post is the delay in giving THR and or dicicil and workers are not invited to negotiate that is until H-3 Lebaran which is not in accordance with the applicable regulations," he said.

In some of these findings, he continued, the thr postage team 2021 East Java recommended to the East Java Disnakertrans namely East Java Disnakertrans must enforce sanctions 5 percent to companies that are late to pay religious holiday allowances in accordance with the provisions of the prevailing laws and regulations.

Then, East Java Disnakertrans is obliged to enforce administrative sanctions to companies that do not make THR payments in accordance with the laws and regulations, East Java Disnakertrans is obliged to conduct social sanctions to companies that do not

thr payment by means of broadcast through print or electronic media.

In addition, urging the East Java Disnakertrans to immediately issue a memorandum of office on violations of companies that do not comply with the Regulation of the Minister of Manpower of the Republic of Indonesia number 6 of 2016 concerning religious holiday allowances for workers or workers in the company, he said.
