Today Hasto Files Exception On KPK Investigation Indictment

JAKARTA - Secretary General (Secretary General) of the Central Leadership Council (DPP) of the Indonesian Democratic Party (PDI) Perjuangan Hasto Kristiyanto is ready to submit a memorandum of objection or exception to the indictment of the alleged obstruction to the investigation into the corruption case of suspect Harun Masiku and the bribery at the Jakarta Corruption Court (Tipikor), Friday, March 21.

Hasto's legal adviser, Febri Diansyah, said that his party would submit two exception documents, namely Hasto's personal objection note and a team of legal advisors.

"We hope that today's stages can not only provide justice for Pak Hasto, but also become an important part of the history of law enforcement in Indonesia," Febri said in a written statement.

He conveyed that Hasto's personal exception, 25 pages thick, would explain how the political operation was carried out on him to sit in the defendant's seat.

Meanwhile, the exception of Hasto's 130-page legal advisory team will be delivered alternately by legal advisers at the Jakarta Corruption Court.

Febri said that the submission of the exception, as harsh and sharp as possible, would remain in the corridor of appreciation for the implementation of the duties of the Public Prosecutor (JPU) of the Corruption Eradication Commission (KPK) and full respect for the Panel of Judges.

"We all hope that the trial and the decision will really come from a clear heart and mind, without intervention from any party and of course can provide justice for all parties," he said.

Another member of Hasto's attorney, Maqdir Ismail added, the exception to be conveyed is a form of legal resistance carried out by the PDI-P as an affirmation of the attitude of rejection of all efforts to silence democracy that is domplementing and on behalf of eradicating corruption.

For this reason, in the objection note, the legal advisory team will be more clearly described as a number of violations of the law that were carried out roughly by KPK investigators.

The actions referred to, ranging from the illegal investigation, a number of actions that violated the Criminal Procedure Code and the principles of due process of law, violations of the suspect's human rights, to four descriptions of the KPK charges that were vague and the application of articles of obstruction of justice or obstruction of investigation.

In this case, Hasto was charged with obstructing or obstructing the investigation of a corruption case that dragged Harun Masiku as a suspect in the 2019-2024 period.

Hasto allegedly obstructed the investigation by ordering Harun, through the Aspiration House guard, Nur Hasan, to submerge Harun's cell phone into the water after the arrests by the Corruption Eradication Commission (KPK) against members of the General Election Commission (KPU) for the 2017-2022 period, Wahyu Setiawan.

Not only Harun Masiku's cellphone, Hasto is also said to have ordered his aide, Kusnadi, to drown his cell phone in anticipation of forced attempts by KPK investigators.

In addition to obstructing investigations, Hasto was also charged together with advocate Donny Tri Istiqomah; the former convict of the Harun Masiku case, Saeful Bahri; and Harun Masiku gave money amounting to 57,350 Singapore dollars or equivalent to Rp600 million to Wahyu in the 2019-2020 period.

The money is allegedly given with the aim that Wahyu strives for the KPU to approve the request for an interim replacement (PAW) for the Elected Legislative Candidate for the Electoral Region (Dapil) of South Sumatra (Sumsel) I on behalf of the Members of the DPR for the 2019-2024 period Riezky Aprilia to Harun Masiku.

Thus, Hasto is threatened with a crime as regulated in Article 21 and Article 5 Paragraph (1) letter a or Article 13 of Law (UU) Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 in conjunction with Article 65 Paragraph (1) and Article 55 Paragraph (1) 1 jo. Article 64 Paragraph (1) of the Criminal Code.
